Sony knowingly conceals a defect in its PlayStation 5 (PS5) video game system that causes the system to suddenly crash while users are playing games, a new class action lawsuit alleges. 

Plaintiff Christina Trejo filed the class action lawsuit against Sony Corporation of America July 12 in an Illinois federal court, alleging violations of state and federal consumer law.

According to the complaint, the PS5 contains a defect that causes the console to suddenly power down while the user is playing video games, often losing saved gameplay. 

“While the PS5 can be used for many entertainment purposes, playing video games on the console is its primary function,” Trejo states. 

“The Console Defect affects users’ ability to play video games and compromises the primary function and overall usage of the PS5.”

Trejo alleges Sony was aware of the Console Defect through warranty repair requests, online consumer complaints, and its own online service resources. 

“However, despite its knowledge of the Console Defect, Defendant failed to, and continues to fail to, disclose the defect to consumers prior to them purchasing the PS5, nor has Defendant taken any substantial action to remedy the problem,” she states. 

Sony has sold millions of defective PS5s, lawsuit alleges

Since its launch in late 2020, Sony has sold more than 19 million units of the system worldwide, the lawsuit states. 

Before its release, Sony advertised the console as coming equipped with “lightning speed, breathtaking immersion [and] stunning games.”

However, months after Trejo bought hers at a Walmart for $499.99 plus tax, the console began to consistently crash. She says if she and others had known about the defect, they wouldn’t have bought the PS5, or would have paid less for it.

Trejo seeks to represent customers nationwide who bought a PS5 in the United States, plus an Illinois Subclass.

She’s suing for violations of the Illinois consumer laws, and for breach warranty and unjust enrichment. Trejo is seeking certification of the class action, damages, fees, costs and a jury trial. 

This is not the first lawsuit the company has faced over its controllers. Last year, Sony was hit with a lawsuit alleging it knowingly sells PlayStation 5s with defective controllers that “drift” in-game without prompting.

Meanwhile, Amazon is facing a class action lawsuit alleging it knowingly sells defective PS5 consoles on its online marketplace.

    My family is the new owner of a PS5 as of Christmas 2023. Unfortunately it crashes within 30 minutes. System tools, including multiple resets, didn’t do squat. Add me to the class action.

      I am having the same issue with my ps5 every time I go to play a ps5 game on my ps5 it allows me to play between 5 – 30 minutes depending on what ps5 game I am trying to play. I been a ps gamer since the ps1 and the ps systems are the only systems I play on. The ps5 is the only ps system I ever had this problem with.

    Honestly can we get someone with legal experience to help us people on here out. I see tons of different communities on the internet all talking about the same issue stated in this lawsuit that was dismissed . I’ve seen it on reddit, YouTube, and other discussions forums. This is an absolute Scam done by Sony/Playstion and they’re wanting more money to fix what they started?? If there are any lawyers that read this I think we all have a strong case to bring this back into a court setting especially as the number of people with this issue is growing.

      Completely agree and just got off the phone with them, our warranty is up and they want us to pay 245.00 to have them fix it!!!!! That’s literally HALF what we paid. It’s rediculous they need to be held accountable. I will not send it in. Done with Sony

    I am currently having the same exact problem stated in the lawsuit. Spent a lot of money on the system, games, accessories and I am not happy. I am talking to the chat support and they refer me to the file a repair. I was cool with that till I saw how much they were charging for a repair. 200+ dollars for a repair when a brand new working console is sitting at 430$. My biggest thing is this is not a user error this is a factory system defect. I asked, so if y’all repair my console and then the same thing happens again what do I do then waste another 200+ dollars? Makes zero sense. I straight up told the chat people that’s the equivalent of a car manufacturer making a vehicle selling it to the public then telling the people that bought that specific vehicle well you’re going to have to pay half the price of the vehicle to get it fixed… If that’s not a scam then I’m losing my mind over. Very frustrated with PlayStation!!

    I have always loved PlayStation products, as I have grown up with them. Our PS5 consistently crashes especially with mortal Kombat 1 and crew motor fest I have taken the PS5 completely apart cleaned it bone dry and it’s still overheats. I went to GameStop where I purchased the PS5 when it first came out and they told me that they’ve been receiving a lot of complaints of their PS5 consoles shutting off and then the only other option was to pay an absorbent amount of money to send it in. For the amount that I paid when it first came out it should be free to correct the issue. I’m no engineer but it seems like it was rushed and it was a simple thing that they overlooked. I would honestly just be happy with a functioning PS5. Luckily our PS4 and PS3 work phenomenally well, never shut down ,and they’re much older .I guess if it’s not broke don’t fix it right?

    Can’t believe this is dismissed, Somebody need to start another lawsuit because it is ridiculous that millions of PS5 owners are still experiencing this idiotic error which we all know is SONY’s fault. Out of warranty units especially just after it expired….They shouldn’t have trusted Chinese manufacturing company to produce and assemble their units, they should have stuck with Japanese made. My PS4 is not even cleaned as much and yet still punch the game flawlessly! IF anybody that is planning to buy PS5 reading this, you better think twice or even hold of on buying it….
