A class action lawsuit wants to hold Dell Technologies responsible for allegedly falsely advertising a laptop, targeted at gamers, in order to boost sales.  

Stating his multi-state class action lawsuit “is necessary to redress the greed” of Dell, lead plaintiff Robert Felter accuses the company of falsely marketing its flagship gaming laptop, the Alienware Area 51M R1. Felter claims that gamers were told the technology would have “unprecedented upgradability,” the “holy grail of mobile computing,” according to his complaint.  

Felter says he purchased the Dell gamers laptop for $2,700 on July 1, 2020. Felter says that Dell released its product near the end of the lifecycle for certain important components of the Area 51M R1. Dell allegedly assured Felter and other gamers that the laptop would not become obsolete because these “core components” could be upgraded.  

“In reality, the Area 51M R1’s Core Components were not upgradeable,” says the class action lawsuit which claims Dell has admitted as such.  

Indeed, Felter says that he asked Dell about upgrading his laptop, but the company told him that none of the components were upgradable in any way, despite representations to the contrary. Felter says the only way he and other gamers can upgrade their now obsolete Area 51M R1 laptops is to spend thousands of dollars more.  

“Dell falsely told consumers that the Area 51M R1’s Core Components were upgradeable to motivate buyers unwilling to purchase a gaming laptop near the end of its Core Components’ generational life cycle and to create a significant (though false) competitive advantage against other gaming laptop manufacturers, as no other company offered a laptop with such capability at the time the Area 51M R1went on sale,” claims Felter in his complaint.  

Felter seeks to represent consumers in multiple states, including Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington, as well as a subclass of California residents, who purchased the Dell Area 51M R1 laptop.  

The class action lawsuit seeks to hold Dell responsible for claims of breach of warranty, false advertising, and violations of state consumer protection laws.

    I would like to be involved as well if still going on, heard that massachusetts isn’t involved? I guess that means I can’t help or be involved? Also sucks for me since the motherboard of my alienware area 51m r1 died recently, laptop has less then 1000hrs on it used very lightly. So they’re telling me that the replacement is at the end of the life cycle and they dont have them anymore. So why did they except it for repairs and charge me parts and labor then? So now I have a paperweight that can’t be upgraded or repaired. Cool thanks dell.
