Just Brands CBD products may be mislabeled.

A California man recently filed a class action lawsuit after laboratory testing on the Just Brands CBD products he purchased revealed the items had much less CBD in them than their labeling promised, he claims.

Miguel Rodriguez of Van Nuys initiated the suit against the Florida manufacturer Just Brands USA Inc. in the U.S. District Court for the Central District of California on May 29. In it, he claims the company misrepresented the true quantity of CBD in their products, and by doing so was able to charge a higher price.  Rodriguez argues is an unfair business practice.

Plaintiff: Testing Contradicts Just Brands CBD Labels

In his complaint against Just Brands CBD, Mr. Rodriguez says he purchased multiple items from the company’s online store in October 2018 and March 2019 after reviewing the product information and images of the items on the website. The information included the amount of CBD purportedly contained in the products.

But subsequent lab testing of 15 of Just Brands’ CBD products showed significant differences between the amount of the compound contained in the items – if any – and the amount advertised on their labels, the lawsuit claims. Eleven of the items tested were found to have less than 50 percent of the amount of CBD listed on the packaging, the suit alleges.

Testers found no detectable amount of CBD in JustCBD’s apple ring gummies, despite the fact that the label on the candies said there should have been 250 milligrams per serving, according to the lawsuit., and less than half of the 100 milligrams said to be contained JustCBD’s honey liquid tincture.

CBD is the common term for cannabidiol, one of several chemical compounds found in the cannabis sativa plant. Unlike THC, the main psychoactive compound in cannabis, CBD consumption does not induce a high in users. CBD’s other properties, though, have led to its becoming a popular ingredient in treatments for pain relief, anxiety and insomnia in recent years.

According to a report published by the New York Times in late 2019, the CBD industry is projected to be a $16 billion industry in the U.S. by 2025. The compound is showing up in new food products, supplements, and beauty and wellness treatments regularly and “more than 60 percent of CBD users have taken it for anxiety, according to a survey by the Brightfield Group, a cannabis market research firm, the article states.

Taking Issue with Just Brands Advertising

Based on the lab results and the company’s labeling and advertising, Rodriguez is accusing Just Brands of unfair business practices that are detrimental to all consumers. His complaint notes that on its website, Just Brands declares “… we believe that you have the right to know exactly what is inside your CBD products.”

Rodriguez says the test results he got on Just Brands CBD products suggest consumers can’t rely on the company’s product labels. He is accusing the manufacturer of inflating the amount of CBD listed on its products in order to charge more money for them.

Other Lawsuits

The Rodriguez suit isn’t the first to be filed against Just Brands.

The CBD manufacturer was hit with a lawsuit in federal court in Florida last year over its product labeling, according to a report published by the legal news outlet Law360.

And in federal court in Illinois, a truck driver has filed a class action suit against the company claiming he was fired for failing a drug test after eating Just Brands CBD watermelon gummies. In that case, filed in October 2019, the driver claims Just Brands labels their CBD candy products “No THC” when the products actually do contain the compound, according to a news report by the ABC news affiliate in Chicago.

Rodriguez, too, is seeking to have his lawsuit become a class action representing a nationwide class of consumers who bought Just Brands CBD products, as well as a subclass of Californians.

    Yes, it seems that JustBrands figured out how to shaft their customers thinking that they could get by with it. 2 or 3 years ago their products were mostly legitimate because I bought their Rainbow Ribbons many times and they definitely were efficacious. A case here of diluting a once good product to make better profit margins. I just bought the same product -last week- and they’re nothing like the original, so I can attest to the fact these people are not selling what they claim to be. Big change in 2-3 years! I know it’s a fact, now. The product was in no way the same as far as pain relief. The product actually was so bad I started investigating and found this website! Wish I’d have known before shelling out over 100 bucks for a (now) dud product! Makes me so annoyed, since these CBD shops never allow returns. Ugh!
