HelloFresh class action lawsuits overview: 

  • Who: Consumers filed several class action lawsuits against meal kit company HelloFresh this year. The U.S. Department of Agriculture’s Food Safety and Inspection Service also issued a public health notice over ground beef products in some of its kits. 
  • Why: Claims against HelloFresh revolve around its auto-renewal practices, online website accessibility and promotional text messages. The public health notice was in regard to potential E. coli contamination. 
  • Where: HelloFresh is available to consumers in the continental United States. 

Meal kit company HelloFresh faced several consumer complaints this year over claims revolving around its auto-renewal practices, promotional text messages and online website accessibility. 

The U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) also issued a public health alert earlier this month over concerns that ground beef products in some HelloFresh meal kits were contaminated with E. coli.

The FSIS did not issue a recall for the HelloFresh meal kits because the products were no longer for sale, it says. The FSIS advised consumers to dispose of the meal kits if they already purchased them. 

“Consumers who have purchased these products are urged not to consume them. These products should be thrown away,” the FSIS says. 

HelloFresh accused of breaking the law with promotional texts

A class action lawsuit filed against HelloFresh earlier this month claimed the company sent unsolicited promotional text messages to consumers without their consent. 

A Florida resident behind the class action lawsuit argues that HelloFresh violates the Florida Telephone Solicitation Act (FTSA) by allegedly sending consumers unsolicited marketing text messages. 

The FTSA prohibits a business from transmitting unsolicited text messages and sales calls to the telephones of Florida residents, according to the HelloFresh lawsuit. 

HelloFresh allegedly uses an automated system to send the promotional text messages with the resident arguing that they invaded his privacy and intruded upon his seclusion. 

HelloFresh subscribers enrolled in auto-renewal program without consent, class action says

Also this month, HelloFresh faced claims that it illegally auto-renews its customers’ subscriptions without providing them with proper notice or being given consent to do so. 

The HelloFresh consumer behind the class action lawsuit argues the company runs an “automatic renewal” scheme that violates California’s Automatic Renewal Law, among other things. 

HelloFresh is accused of enrolling consumers who sign up for the company’s services into a week-to-week auto-renewal program that results in weekly charges. 

“In doing so, Defendant fails to provide the requisite disclosures and authorizations required to be made to and obtained from California consumers under California’s Automatic Renewal Law (ARL),” the HelloFresh lawsuit states.

The HelloFresh consumer claims the company is legally required to obtain affirmative consent before enrolling a new customer into an auto-renewal program in addition to providing them with a clear presentation of its terms. 

HelloFresh allegedly failed to make website fully accessible for blind, visually impaired 

A consumer filed a separate class action lawsuit against HelloFresh in May, arguing the company failed to make its website fully accessible to individuals who are blind or visually impaired. 

The consumer behind the complaint argues HelloFresh violates the Americans with Disabilities Act, among other things, by allegedly denying individuals who are blind or visually impaired with equal access to the goods and services that the company provides. 

HelloFresh has “thousands of access barriers” on its website that make it “difficult if not impossible” for individuals who are blind or visually impaired to successfully navigate it or even complete a transaction, the HelloFresh lawsuit alleges. 

The consumer argues that individuals who are blind or visually impaired must “rely on sighted companions to assist them in accessing and purchasing” from the HelloFresh website.

    Just saw an add for 18 free meals. Had to select what kind of meals I wanted to receive, for how many people, how many recipes per week. Then I had to create an account, enter my delivery address, phone number, agree to receive promotional texts etc before I FINALLY get to see that these meals are NOT FREE but there seems to be a SMALL discount on a larger fee for which I have to enter my credit card details .
    – Extremely deceptive practices in terms of what they promised.
    – they got me to sign up for an account and collected all my contact details before disclosing that the free meals weren’t free
    – whatever free meals there were there certainly weren’t 18.
    Massive scam and someone needs to protect consumers and stop these deceptive and predatory marketing practices.

    They scammed me out of almost $50 and I want my money back. I was never informed they would be charging my card today. As soon as I seen the charge, I messaged a Hellofresh agent, but was told it was too late to give me a refund. A bunch of baloney that made me mad. I was supposed to take off money from my card to pay rent and now I have to borrow $50 from my boyfriend because hellofresh took my money without my consent. I had no idea they would “pick my meals for me” and then charge my card for a shipment. Ridiculous!

    Definitely add me to the list!
    I want my money back & they need to be held accountable!
    I had canceled months ago & then they suddenly started my subscription again without my consent & sent me produce & meat that was lukewarm meat, even though the weather was cold outside. They also debited my checking account for $90 for a box of 3 meals!
    And after reading about the E-Coli, I don’t want to touch ANY of their food!
    That was the reason I canceled in the FIRST place!

    They charged me 2x within 3 days of $145 each time. Im new to this and reading your comments I’m afraid to even eat this. I’ve tried to call they kept me on hold for like 45 minutes then hung up on me. I want my money back. The box hasn’t even came yet so thats 290 and haven’t received nothing. Please add me

    Please add me to the lawsuit. I do not eat beef or pork and when I called them a guy by the name of “Leo” said there is nothing he can do! Which I believe was a lie!

    Please add me. I received old and molded produce. Carrots were grayish, and you could bend them easily, green veggies were darkened and had spots; very wilted, and more. They automatically sent me boxes with meat even though I previously ordered vegetarian meals. They have refused to give me a refund on my box.

    I made order wasn’t the price on promotion code then sent chat and tried to cancel around fifteen minutes later and they said it was to late to cancel a d then at end of chat send me sad emjoi and praying hands wtf.

      just happened to me too said 134.00 but was charged 220.00 I immediately called N messaged..told too late to cancel..for that week and no refund on difference in original price and what I was charged..on top of that I was asked how likely was i to recommend them to family friends and co-workers..lol I responded with no way in hell…
