Chevolet Camaros are at the center of a class action lawsuit over faulty airbags.

Airbags in the 2010 and 2011 model Chevy Camaros allegedly don’t work when passengers are sitting in the front seat. Now a class action lawsuit claims that the vehicles should have been recalled over the alleged defect. 

Edward Jackson, the plaintiff, claims that a manufacturing defect causes the right front passenger airbag to turn off when a person is seated in the Camaro, which means the airbag will not deploy in the case of an accident, according to a class action lawsuit that was filed on January 15. 

The issue can be traced back to the vehicles’ passenger presence sensor (PPS), which are allegedly prone to tearing, according to the complaint. Jackson claims that in late 2009 or early 2010 he issued an alert to the seat supplier, which led to a new PPS being installed in vehicles by September 2010. By this time, the complaint alleges, tens of thousands of vehicles had already been fitted with defective PPS pads, which General Motors purportedly chose to ignore.

In January 2012, Jackson purchased a new 2011 Chevrolet Camaro at a Chevrolet dealership in Virginia. Prior to purchasing the vehicle he was not informed of any potential airbag defect, and claims that if he had known that there was an issue with the airbags, he would not have purchased the vehicle. 

In May 2019 Jackson’s vehicle airbag service light illuminated, while the passenger airbag indicator stated it was off whenever a person would sit in the passenger seat. He took the car to a GM Dealer and paid $163.86 to have the issue resolved, according to the complaint. The service representative advised that the PPS pad sensor needed to be replaced at a cost of $1,799, according to the complaint. Jackson stated that he chose to purchase the pieces online for $667.55, and had a mechanic install the parts for an additional $300. 

Complaint Alleges General Motors Knew a Recall Was Required

In 2010, General Motors alerted its dealers that a number of customers had complained about the airbag sensor light illuminating on the dashboard, notifying them that the airbag on the passenger side was off when an adult was positioned in the seat, according to the class action. 

Based on the alert, the complaint alleges that General Motors was aware of the airbag defect and should have issued a safety vehicle for the vehicles. 

Under the Transportation Recall Enhancement, Accountability and Documentation Act (TREAD Act), once a manufacturer discovers a vehicle defect it must immediately notify vehicle owners, as well as the Secretary of Transportation, according to the complaint. By not notifying car owners about the condition of the vehicle, General Motors violated the TREAD Act, the complaint contends. 

Despite the alerts made, General Motors has continued to deny the existence of an airbag defect, according to the complaint. 

Jackson seeks monetary damages and actual damages for him and others in the class that will be determined at trial, plus the covering of attorney fees. 

The class action refers to fifth generation, 2010-2011 Chevrolet Camaro vehicles that were purchased or leased by all consumers in the United States, other than California. 

Potentially defective airbags are just the latest issue General Motors has been facing recently. Vehicle owners have reported a range of problems with the vehicles, which has led to a number of class actions being filed.

In November 2020, General Motors announced that the company was adding 7 million SUVs and trucks to a recall of vehicles with potentially malfunctioning airbags due to a vehicle defect. The recall has been in effect for more than a decade, and includes tens of millions of vehicles manufactured by several automakers.

In November 2020 a class action lawsuit was filed against General Motors surrounding claims that an alleged vehicle defect can cause the battery in the Chevrolet Bolt to suddenly burst into flames and cause serious injuries.

    WHAT ABOUT 2009 CHEVY COBALT THAT HAD AIRBAG REPLACEMENT ON RECALL HAD THE RECALL WORK DONE AND NOW STILL THE AIRBAG LIGHTS DO NOT WORK PROPERLY AND AIR BAG NEVER CAME OUT WHEN REAR ENDED BY A UNITED STATES POSTAL DELIVERY TRUCK.

    I had a 2001 Tahoe and I hit the gard rail so hard the front wheel broke free ,for my time I got a broken shoulder, cuts and gaashes along with a concussion and not not one airbag deployed !!! IS THERE ANY CLASS ACTION SUITE ON THAT ?
