  • Keurig filed a motion to dismiss the class action lawsuit May 3 in a New York federal court, stating the plaintiffs were using the wrong product instructions.

Keurig and Bed Bath & Beyond sell defective Keurig coffee makers and liquid descaling solution, a new class action lawsuit alleges.

Plaintiff Doreen Cahill filed the class action complaint against Keurig Green Mountain Inc. and Bed Bath & Beyond Sept. 1 in a New York federal court, alleging violations of state and federal consumer laws. 

The lawsuit refers to the Keurig K-Supreme, K-Supreme Plus, and K-Supreme SMART Single Serve Coffee Makers and the company’s liquid descaling solution. 

Cahill says all of the coffee makers suffer from identical defects in design.

She says that if consumers follow the process according to the instructions provided by Keurig on its descaling solution, the process “completely disables” the coffee makers. 

“The defect makes it so the Coffee Makers cannot be used or properly maintained and renders them unsuited for their principal and intended purpose,” she says. 

Keurig coffee makers have multiple complaints online

The problem occurs because the coffee makers allow the water reservoir to empty completely during the descaling process without stopping to tell the user to add more water, causing them to overheat, the lawsuit says.

The only way for the Coffee Makers to be brought back to life is to disassemble them and use a paperclip to depress a miniscule reset button in the center of the thermal switch, it states.

“Keurig has known or should have known about the defect in the descaling process and the inadequate instructions provided on its website and the Descaling Solution bottle since the release of the original K-Supreme Coffee Maker,” Cahill says.

She adds that each of the coffee makers’ webpages are rife with one and two-star reviews from around the country pointing out the alleged problems caused by following Keurig’s descaling instructions.

Cahill is looking to represent anyone in the United States who purchased the coffee makers or the descaling solution, plus New York subclasses. She is suing for breach of warranty, unjust enrichment, negligent misrepresentation, fraud and violation of New York business laws. 

She is seeking certification of the class action, damages, fees, costs and a jury trial.

In August, Keurig paid $10 million as part of a class action settlement to resolve claims it misled consumers about its K-Cups being recyclable, and consumers do not need proof of purchase to make a claim.

    I want to be added I have a $200 piece of junk on my counter and the only thing the company offered me was a 20% discount to purchase another one. I descaled he machine and it never worked again!

    My second K-Supreme Plus failed. Since it was a replacement for the original unit that failed Keurig stated that if it failed it would not be replaced under warranty. There are a number of flaws of which two are serious flaws all revolving around descaling. One defect is that the add water light does not come on. Had this happen on my second machine. Not having the machine protect itself if there is no water causes the machine to get very hot internally and you could smell that something had burnt. On the first machine the light came one but the descale light never went off. If the unit gets hot the temperature switch trips causing the unit not to work any longer. The switch is called a thermostat or temperature switch. Keurig uses a re-settable switch that needs to be manually re-set which requires the unit to be opened to depress the button on the switch. The switch that they should be using manually resets when it cools down. I am sure that the use of the wrong switch is the cause of many returns. The Keurig descaling instructions are flawed. If you follow the procedure step by step without leaving time to cool the unit down between cycles you will cause the machine over temp and become inoperable.

    Just descaled my Keurig Supreme with their solution and it is now dead. It got really hot and even the plug was too hot to touch without a silicone oven mitt. After cooling it will do nothing.

    I just bought the new keurig for $200. In February. It said to descale. I descaled. The descale would not go off. Called keurig. After about 10 steps…pics, pics of serial #, pic of pot, letter, pic of pot with letter next to it, and more they sent me a new one. ONE MONTH after getting new one my new one said descale. I bought descale, and descaled…it froze up. The lady stated it wasn’t under warranty because it was a replacement!!! A month old $200.(on sale) keurig.
