Mead Johnson & Co. agreed to a $8.4 million false advertising class action lawsuit settlement to resolve claims it inflated the number of bottles its Enfamil baby formula products could make. No proof of purchase is required for consumers to file a claim.
The settlement benefits consumers who purchased certain Enfamil products between Jan. 1, 2017, and June 23, 2022. A full list of covered products is available on the settlement website.
Enfamil is a baby formula brand that includes a number of products designed for infant needs. Certain product lines aim to benefit neurological function while others boast organic ingredients.
Some consumers were disappointed by the number of servings each Enfamil product makes. This issue is especially pressing during the ongoing formula shortage in the United States.
According to a class action lawsuit, Enfamil baby formula products are deceptively marketed as able to make more servings than is realistic. For example, a 35.2-ounce container of Enfamil NeuroPro allegedly promises to make 63 servings of 4 fluid ounces
“Contrary to these representations, however, the products contain nowhere near enough powder formula to make the represented number of bottles of liquid formula when following the ‘Instructions for Preparation & Use’ on the side labels of the Products,” the Enfamil class action lawsuit contends.
In reality, each of the products make 8.9% to 10.2% fewer servings than promised by the product packaging, according to independent expert testing. As a result, consumers allegedly overpaid for Enfamil products believing ] they would get more servings of formula than they did. Consumers say they wouldn’t have purchased the products or paid as much if they knew how many servings were actually made per container.
Mead Johnson & Company hasn’t admitted any wrongdoing but agreed to pay $8.4 million to resolve these allegations.
Under the terms of the Enfamil settlement, class members can collect a cash payment based on the number of products they purchased. Each purchased product can result in up to $3.
Without proof of purchase, class members are limited to claiming five products for a maximum payment of $15. With proof of purchase, Class Members can claim up to 15 products for a maximum payment of $45.
In addition to providing cash payments, the settlement promises changes to Enfamil labels to better reflect the serving capacity of the products.
The deadline for exclusion and objection is Sept. 15, 2022.
The final approval hearing for the settlement is scheduled for Sept. 22, 2022.
In order to receive a payment from the Enfamil false advertising settlement, class members must submit a valid claim form by Oct. 31, 2022.
