Copper Chef set of pots and pansA class action lawsuit has been filed against Tristar Products by consumers who claim that their Copper Chef cookware is defective.

Plaintiffs Marshall Slutsky and Glenn Graeves allege that Tristar Products market their Copper Chef cookware as having non-stick technology and their pans will never peel, scratch, or chip. 

In addition, the plaintiffs say that because of these claims, Tristar states that their pans will last a lifetime.  

The Tristar Products class action alleges that contrary to these claims, the products do not work as advertised.

A few days after Slutsky purchased two Copper Chef Pans at Walmart, he says he noticed that his pans began to deteriorate. 

He claims that food began to stick to the pans after two days of use and the cookware surfaces began to change color, all the while claiming that he used the products in accordance with the instructions. Slutsky says he contacted the company and asked for a refund.

“Defendant claimed that Plaintiff Slutsky’s Copper Chef Pans were not defective; rather, Plaintiff Slutsky had failed to properly ‘season’ his pans, despite the fact Defendant’s instructions do not require ‘seasoning,’ and declined to refund Plaintiff Slutsky’s purchase price,” the Copper Chef class action lawsuit states.

Plaintiff Graeves found himself in a similar situation after purchasing three sets of Copper Chef pans from Amazon. After the pans began to deteriorate, he contacted Tristar Products by telephone and demanded warranty coverage for his products. The defendant reportedly claimed that the pans were not defective and stated that Graeves misused them.

“Simply put, Copper Chef Pans are unsuited for their intended purpose and do not live up to Defendant’s baseless marketing claims,” the Copper Chef class action lawsuit claims.

The Tristar class action lawsuit states that the company claims that its Copper Chef pans use “Cerami-Tech Non-Stick Technology” that means nothing will stick to the pan and which “provides instant food release and eliminates the need for added fats and oils.”

The plaintiffs state that contrary to the claims made on their website, the pans do not follow its various warranties, including that they last a lifetime, as they inevitably lose their non-stick functionality.

“Defendant knew, or should have known, that Copper Chef Pans are defective, unfit for their ordinary and intended purpose, and incapable of performing as warranted,” the plaintiffs allege.

In addition, the Tristar Products class action lawsuit states that the company concealed the fact that their products were defective and does not provide a refund from consumers when requested. The company claims that they do not provide a refund because their customers are not using the products according to the instructions.

The Copper Chef class action also states that Tristar Products continues to sell their non-stick pans throughout the United States at Walmart and online at Amazon while misrepresenting the performance of their products. This, the plaintiffs allege, is causing millions of dollars in damages.

The plaintiffs bring claims in violations of various states’ consumer fraud laws, breach of express and implied warranties, and violations of the Magnuson-Moss Warranty Act.

Potential Class Members include: “All persons and entities in the United States who purchased Copper Chef Pans.”

    Hi I had the same issue with both Red Copper and Copper Chef, I use a plastic spatula and eggs always stick.I got the Copper Chef as a gift 🎁.

    I purchased the black diamond pots and pans. All my pits are chipped and and the black surface is coming off. The egg pan sticks to everything and the eggs are the worst. Don’t buy these

    I bought an 8″ and 10″ copper chef skillets. they were seasoned per the instructions several times. I was able to cook eggs “one” time with out sticking. When I contacted copper chef (tristar products) I was told to reseadson them and the non stick capabilities do wear off. It does within a week. When asked for a refund I was informed I weas told there was nothing wrong wirth the skillets I just don’t season the right, I did according to the reps instructions

      Likewise, plus I have chips all in my pans. I have even had to throw a few out because they had gotten so bad.

    Copper Chef Black Diamond 10″ Pan
    Stubborn Oil stains won’t come off. Because of this, the pan is no longer non-stick.

    I have purchased all of Copper Chef pots and pans. Totally disappointed! Eggs and everything else is sticking from day one!😡 I tried recipes in the cookbook and still disappointed!

    My Copper Chef skillet 12″ gave me 2 degree burn on my stomach. Was pouring the oil out of pan and oil came thru the handle somehow and poured onto my stomach thru my shirt. I now have second degree burn as big as an orange. 3/14/22. I will never buy one again. How does this happen.

    These pans are not non stick pans even when using cooking oil. They are also not scratch resistant. All my pans look like they are not clean even though they are. You can’t get your money back and they will send a replacement for a fee. Rip off!!
