Waffle House offers an ‘All-Star Special’ breakfast combo with a misleading discount, a new class action lawsuit alleges.

Plaintiff Jessica Collins filed the class action lawsuit against Waffle House Inc Dec. 17 in a Florida federal court, alleging violations of state and federal consumer law.

According to Collins, Waffle House sells breakfast combos of ingredients including eggs, waffles, sausages and bacon for an advertised “All Star Special” price of $10, less than the $13.25 it previously was sold for, it says.

However, the $10 price is misleading because these three items were not previously sold together at the strikethrough price of $13.25, Collins says.

“This means the reference price does not provide a legitimate basis for advertising a price comparison to the offered price.”

“By listing the All-Star Special price as formerly $13.25, the ‘bargain’ advertised to customers is a false one, such that they are not receiving the unusual value they expect because the $10 price is its regular price,” the lawsuit states.

Waffle House does not deliver the bargain that customers expect, lawsuit states

The $13.25 is based on the total price of the three items when purchased separately, because the toast, eggs and grits, hash browns or tomatoes costs $5.25, the waffle costs $4.50 and the bacon, sausage, or ham costs $3.50, the lawsuit states.

However, because the All-Star Special was not sold at the strikethrough price of $13.25, getting the bacon, sausage or ham without paying more than $10.00 is not the bargain or value customers expect.

The plaintiff is looking to represent a Florida class of consumers who bought the All-Star Special breakfast, plus a consumer fraud multi-state class of consumers from Texas, Kentucky, Louisiana, Oklahoma, Mississippi, Virginia, Arkansas, Alabama and Arizona.

Collins is suing under Florida and state consumer laws and for breach of warranty and unjust enrichment.

    I went to waffle house in king north carolina my bill was 26.75
    I left 8 dollar tip paid with debit card next day a amount of 8034.76 was charged from waffle house!!!!! I called said it would be 7 days before I get money back I have bills and no money now.

      Toast is 2.50, grits or hash browns 3.00, waffle 4.50, and meat 3.50 when items are sold separately. The above pricing that the plaintiff references is false.
