Trident mint class action lawsuit overview: 

  • Who: Kristen Lesorgen filed a class action lawsuit against Mondelēz Global LLC. 
  • Why: Lesorgen claims Mondelēz Global misled consumers into believing that its “Original Flavor” chewing gum was flavored with real mint. 
  • Where: The class action lawsuit was filed in Illinois federal court. 

Mondelēz Global misled consumers about the source of the flavoring of its “Original Flavor” Trident brand chewing gum, a new class action lawsuit alleges. 

Plaintiff Kristen Lesorgen claims Trident misrepresents that its Original Flavor chewing gum is flavored with either mint or peppermint since its packaging contains a picture of a blue peppermint leaf. 

Lesorgen argues the alleged misrepresentation injures consumers who are led to believe the gum is flavored with mint, since it is the most popular flavor of gum “because it is associated with freshness.” 

“By representing the Product as ‘mint’ or ‘peppermint’ without any qualifying terms, consumers and Plaintiff expected its taste was from mint or peppermint ingredients,” states the Trident class action. 

Lesorgen wants to represent an Illinois class and multi-state consumer fraud class of individuals who have purchased Trident brand Original Flavor chewing gum. 

Trident Original Flavor chewing gum allegedly worth ‘materially less’ then represented

Despite the picture of the peppermint leaf on its front packaging, the Trident Original Flavor chewing gum does not list any mint or peppermint in the ingredient list for the product, according to the Trident class action. 

Lesorgen argues that the product is worth “materially less” than the value it is represented as by Trident due to the alleged misleading representations and omissions. 

“Natural and artificial flavor are less expensive and more concentrated than real mint and peppermint, so less of it needs to be used,” states the Trident class action. 

Lesorgen claims Trident is guilty of fraud, negligent misrepresentation, and unjust enrichment, and in violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, the Magnuson Moss Warranty Act, and various state consumer fraud acts. 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of monetary, statutory, and/or punitive damages for herself and all class members. 

A similar class action lawsuit was filed against Unilever United States earlier this month by a consumer arguing the company misrepresents that its Breyers brand Mint Chocolate Chip ice cream contains real mint
