Starbucks, Target class action lawsuit overview:

  • Why: Jennings claims the defendants failed to ensure the safety of their products, causing her to drink a coffee drink contaminated with dangerous bacteria.

Starbucks and Target sold beverages that contained recalled Oatly brand oat milk, potentially causing customers to become sick due to bacteria contamination, a class action lawsuit alleges.

Plaintiff JoAnne Jennings says she purchased and consumed a coffee drink from a Starbucks that was located inside a Target store Sept. 30. She says her beverage contained Oatly oat milk that had been included in a widespread recall of Lyons Magnus products due to cronobacter sakazakii bacteria contamination.

Shortly after consuming the Starbucks drink, Jennings says she became ill and was hospitalized. She was diagnosed with bacterial and parasitic infections caused by her consumption of the recalled Oatly oat milk, the Target and Starbucks class action lawsuit alleges.

Oatly products recalled in August due to potential bacteria contamination, class action says

Defendants Lyons Magnus and TRU Aseptics manufacture and sell a variety of protein shakes and powders, dairy alternatives and other nutritional supplements in the United States. They recalled 53 products in August due to potential bacterial contamination, the Starbucks and Target class action lawsuit explains.

Oatly’s barista edition oat milk was reportedly among the products recalled due to potential cronobacter sakazakii contamination. Other brands reportedly affected by the recall include Stumptown, Glucerna, Intelligentsia, Aloha, Kate Farms and Premier Protein.

The Target and Starbucks class action lawsuit claims the duo continued to use the recalled Lyons Magnus and TRU Aseptics products despite the known risks. Jennings says she decided to sue because of the defendants’ “negligent failure to ensure the quality and safety of their products.”

Jennings filed the Target class action lawsuit on behalf of herself and a proposed class of consumers who purchased the recalled Lyons Magnus products for household or business use.

The class action lawsuit asserts claims for breach of express warranty, breach of the implied warranty of merchantability, fraudulent misrepresentation, fraud by omission, unjust enrichment, negligence and violation of the Indiana Deceptive Consumer Sales Act.

Another recent Starbucks class action lawsuit alleges the coffee company misrepresents its French Roast Ground 100% Arabica Coffee and fails to note that it contains added potassium.
