A number of complaints have recently been filed against food companies and restaurant chains over claims they falsely advertised their products to consumers. 

The false advertising claims revolve around ingredient amounts, nutritional value, preservatives and allegations one product contained unsafe levels of cadmium. 

Taco Bell inflates amount of ingredients some products contain, class action claims

A consumer filed a class action lawsuit against Taco Bell Corp. late last month, arguing the company falsely advertises the amount of beef and other ingredients some of its products contain. 

The consumer claims Taco Bell food advertisements and menu ordering boards depict some of its products — including its Grande Crunchwrap and Mexican Pizza, among others — contain more than twice the amount of ingredients than they actually have. 

“Taco Bell’s promise to consumers of a large portion of food with their purchase are also causing consumers to come to, or order from, Taco Bell’s restaurants and make purchases that they would not have otherwise made,” the Taco Bell class action states. 

Dole deceptively markets certain packaged fruit snacks as healthy despite sugar levels, class action alleges

A pair of consumers filed a class action lawsuit against Dole Packaged Foods in July, arguing the food company deceptively markets certain of its packaged fruit snack products as being healthy. 

The consumers argue certain Dole packaged fruit snacks — including parfaits, gels and juice products  — are marketed as being healthy despite allegedly containing an unhealthy amount of sugar. 

“Because loading these products with FA Sugar and marketing them as good for you is directly contrary to the science, Dole’s claims are false or at least highly misleading,” the Dole class action states. 

Pacific Coast Producers allegedly falsely markets canned tomatoes as free of preservatives

A class action lawsuit was filed against Pacific Coast Producers last month over claims the company falsely markets its canned tomatoes as being “preservative free,” despite them allegedly containing citric acid, a “well-known preservative.” 

The consumer behind the complaint argues the company, which is the largest tomato canner in the U.S., is misleading consumers by marketing that the canned tomatoes are preservative-free. 

“Defendant clearly lists ‘No Preservatives’ on Products’ label, capitalizing on the preference of health-conscious consumers to purchase foods that are free from preservatives,” the Pacific Coast Producers class action states.

Bob’s Red Mill fails to disclose some flaxseed products contain unsafe levels of cadmium, class action says

A consumer filed a class action lawsuit against Bob’s Red Mill Natural Foods at the beginning of the month. The plaintiff argues the company fails to disclose some of its flaxseed products allegedly contain unsafe levels of cadmium. 

The consumer argues Bob’s Red Mill is falsely marketing its flaxseed products as healthy, due to them allegedly containing unsafe levels of cadmium, a known human carcinogen linked to a number of health issues. 

Bob’s Red Mill has also been accused of failing to test its products for heavy metals, such as cadmium. 

Ghost kitchens file countersuit against MrBeast after YouTuber claims they created low-quality burgers for MrBeast Burger

In other food-related lawsuit news, the so-called ghost kitchens behind MrBeast Burger filed a countersuit against MrBeast — also known as Jimmy Donaldson — earlier this month over claims the YouTube personality breached his contract with them. 

The countersuit was in response to a lawsuit filed by MrBeast against Virtual Dining Concepts and Celebrity Virtual Dining over claims they created burgers that were of quality and that hurt the MrBeast brand. 

The ghost kitchens argue MrBeast attempted to force them to expand too quickly by opening 300 virtual restaurants following a successful pop-up launch in North Carolina. 

Judge dismisses claims Kraft falsely advertised time it takes to cook single-serving cup of Velveeta mac and cheese

A federal judge in Florida dismissed a class action lawsuit against Kraft Heinz Co. last month that claimed the company falsely advertised the amount of time it will take to prepare a single cup of its Velveeta brand mac and cheese. 

The judge ruled the consumer behind the complaint had a lack of standing since they continued to purchase the product after finding out it took longer to prepare than advertised. 

Food-related complaints involving Inventure Foods, McDonalds, A&W, Keurig Dr Pepper resolved

In recent food-related settlement and award news, Inventure Foods agreed to pay $900,000 last month to resolve claims the company falsely advertised its TGI Friday’s brand Mozzarella Sticks Snacks contain real mozzarella cheese

A jury in Florida, meanwhile, made an $800,000 verdict against McDonald’s in July after it found the company — along with franchisee Upchurch Foods — was liable for second-degree burns suffered by a 4-year-old in 2019 that were caused by its Chicken McNuggets

Lastly, A&W Concentrate Co. and Keurig Dr Pepper Inc. agreed to pay $15 million in July to end claims they falsely advertised their root beer and cream soda product contained real vanilla.
