Bolthouse Farms class action lawsuit overview:

  • Who: Plaintiff Gwendolyn Smith has filed a class action lawsuit against Bolthouse Farms.
  • Why: Bolthouse Farms allegedly falsely touts its smoothie products as being natural even though they contain harmful synthetic chemicals.
  • Where: The Bolthouse Farms class action lawsuit was filed in New York federal court.

Wm. Bolthouse Farms Inc. markets its Green Goodness Fruit Juice Smoothie products as a nutritious “100% Fruit Juice Smoothie” but they actually contain harmful synthetic chemicals, a class action lawsuit alleges.

Plaintiff Gwendolyn Smith says Bolthouse Farms has “engaged in pervasive marketing efforts” touting its smoothies as a natural fruit juice beverage. What the company allegedly fails to disclose, however, is that the products contain per- and polyfluoroalkyl substances (PFAS).

PFAS are synthetic chemicals that are known as “forever chemicals” because they accumulate in the body over time, the Bolthouse Farms class action lawsuit explains.

Exposure to PFAS may lead to reproductive issues, developmental delays in children, increased risk of certain cancers, impaired immune response, hormone interference, increased cholesterol, and/or increased risk of obesity, according to findings by the U.S. Environmental Protection Agency.

Bolthouse Farms class action says company markets ‘natural’ product to health-conscious consumers

Bolthouse Farms’ smoothies are a ready-to-drink refrigerated juice product with various nutritional claims on the label, such as “no sugar added,” a good source of vitamins and antioxidants, and healthy ingredients, according to the Bolthouse Farms PFAS class action lawsuit.

These claims are meant to appeal to the growing market of health-conscious consumers who seek to consume products with all-natural ingredients, Smith alleges.

Smith says she has purchased Green Goodness Fruit Juice Smoothie products numerous times. After reviewing the packaging, labeling, and marketing materials, she believed that the smoothies were safe for consumption and were free of harmful chemicals that could negatively affect her health.

The Bolthouse Farms class action lawsuit states that Smith sought independent third-party testing for the smoothie products, which found significant levels of some forever chemicals.

Smith says that, had she known about the Bolthouse Farms PFAS content, she would not have purchased the smoothies or would have paid less for them.

The Bolthouse Farms class action lawsuit asserts claims for violations of the Magnuson-Moss Warranty Act, the New York Deceptive Trade Practices Act, breach of express warranty, fraud, and unjust enrichment.

Bolthouse Farms is just one of the latest companies to face allegations that it deceptively labels its products as natural when they actually contain synthetic ingredients.
