An Illinois woman says that Entenmann’s brand “All Butter Loaf Cake” is manufactured by Bimbo Bakeries USA Inc using soybean oil, and not pure butter, as consumers might expect.
Lead plaintiff, Vicki Elder, filed a class action lawsuit in Illinois federal court this week claiming that she and other consumers rightfully expect the product to be made with butter and not butter substitutes. While there is butter in Entenmann’s All Butter Loaf Cake, the product also contains soybean oil, which the company disguises by adding artificial flavors, alleges the class action lawsuit.
Elder says that she and other consumers were invited by Bimbo on its website to “[i]ndulge yourself with the rich taste of pure butter in our All Butter loaf.” Elder says she “prefers butter to butter substitutes and avoids butter substitutes like vegetable oils.” Indeed, the plaintiff says that she paid more for Entenmann’s loaf than competing products because she believed it was made using only butter.
Despite Bimbo’s representations that Entenmann’s loaf is made with “pure butter,” the ingredient list reveals that it also contains soybean oil, alleges the class action lawsuit. The plaintiff says that cakes made with oils are generally drier and less moist and dense than those that contain butter; however, Bimbo has found a way to dupe consumers by also using artificial flavors in the Entenmann’s loaf.
“Defendant does not deny the Product contains artificial flavors but fails to tell consumers that these flavors give the impression the Butter Loaf Cake has more butter than it does,” contends the class action lawsuit.
The plaintiff says that artificial vanilla is used in the Entenmann’s loaf, tricking consumers into thinking that the product has more pure butter than in reality. Elder says that lab tests reveal that the product contains much less butter than most consumers would expect.
Elder claims that she and other consumers were duped into purchasing and paying more for Entenmann’s All Butter Loaf Cake, pointing out that competing products disclose that they are made with artificial flavors.
A New York City woman has also filed a class action lawsuit claiming Entenmann’s All Butter Loaf Cake is not “all butter” because it contains vegetable oils.
In her class action lawsuit, Elder wants to represent a Class of Illinois and Wisconsin residents who purchased Entenmann’s brand “All Butter Loaf Cake.” She is seeking damages on behalf of the Class as well as a court order forcing Bimbo Bakeries to disclose the use of oil and artificial flavors in its Entenmann’s brand loaf.
