Samsung Galaxy Earbuds Class Action Lawsuit Overview:  

  • Who: A New Jersey consumer lodged a class action lawsuit against Samsung Electronics America, Inc.
  • Why: The plaintiff claims that a defect in Samsung Galaxy earbuds can cause irritation and even an allergic reaction in users.  
  • Where: The class action lawsuit was filed in New Jersey federal court.  

Samsung Galaxy earbuds are made of a material that can cause users to experience “itching, burning, redness, blistering, flaking, scabbing and/or fluid leaking” from their ears, according to a class action lawsuit filed in New Jersey federal court Thursday.  

Lead plaintiff, Cheryl Westerkamp, wants to represent consumers nationwide who purchased Samsung Galaxy Buds Pro headphones. She claims that Samsung knew of the problem, but continued to sell the earbuds anyway.  

Westerkamp, a New Jersey resident, says she spent more than $200 on a pair of Samsung Galaxy earbuds in April. She claims that shortly after using the pricey headphones, she began to experience soreness in her ears.  

The plaintiff says that, initially, she could not figure out the problem, and she continued using the Samsung Galaxy earbuds, but her ears began “scabbing, flaking, oozing.” 

Westerkamp says she stopped using the product in July and contacted the company. She claims she was instructed to spend another $22 on aftermarket foam tips to use with her Samsung Galaxy earbuds; however, the plaintiff claims the tips did not help and she is now left with Samsung Galaxy earbuds and foam tips she cannot use.  

Complaints About Allergic Reactions to Samsung Galaxy Earbuds 

Samsung Galaxy earbuds have been on the market for months and, prior to their release, the company sold many other in-ear headphones, points out the class action lawsuit.  

“Based on the numerous reports in the public domain of the Defect manifesting within days or weeks of regular use, on information and belief, Samsung received calls, communications, correspondence, or warranty claims from consumers regarding the Defect with the Earbuds as early as January 2021,” states the complaint.  

Indeed, despite the complaints, Westerkamp says she and other consumers were still able to purchase allegedly defective Samsung Galaxy earbuds months later — paying hundreds of dollars for a product they expected to last many years.  

Further, Westerkamp says that she and other Class Members are forced to pay out-of-pocket for any medical treatment they require for allergic reactions to Samsung Galaxy earbuds.  

The plaintiff accuses Samsung of fraud and unjust enrichment. She wants the company to reimburse a nationwide Class of consumers, along with a New Jersey subclass, for the purchase of their Samsung Galaxy earbuds. Westercamp also wants Samsung to pay for any out-of-pocket medical costs and the purchase of aftermarket products used in an attempt to alleviate the problems caused by the product.  

This is far from the first consumer to complain about Samsung products. The company has faced class action lawsuits for Samsung Galaxy Note 4 defects, 3D Smart TV Capacitors, shattering Galaxy cameras, and leaky remote control batteries.

    Is thus still going on? My earbuds blew out both my eardrums. Contacted samsung and all they did was refund me my money. They also claimed they knew about the defect aswell.

    Is this lawsuit still going? I’m trying to figure out how can I get a refund since I bought the buds maybe a year or two ago and I didn’t know they were using latex, my ears are itching, scalding and warm when I use them, also I tried to buy silicone ones but they are bigger and don’t fit in the case when I want to charge the buds ! What a waste!

    Unbelievable, I too am having this issue with the ear. I thought it was just me. I actually owned a pair of galaxy buds that not only fit better & held better, they did not give me any allergic reaction in the ear. But because I lost one, I ended up buying the upgraded model (Galaxy buds pro). Those gave me an allergic reaction in the ear. I figured I just needed to make sure they were cleaned but nope! I rarely used them and delt with it. Then the GB Pro 2 launched & I decided to upgrade by trading in & still spend $$ (for the just in case). STILL!!! same issue as everyone else– itchy, leaky substance, stabbing, flaky stuff—YUCK!! AGAIN I’m stuck with a pair of buds I don’t use. Trying to find a solution by buying another brand and I come across this in the threads. I’m even willing to buys foam tips as suggested in another thread I read to somehow save my self from spending on a new pair from another brand as I am a Samsung fan whose highly disappointed with the ear issue I’m having. But if Samsung knew/knows of this issue and does nothing, then they are flat out wrong!

    I’m experiencing the itchy burning sensation. I didn’t think the earbuds were causing it, until I ran across this thread. I google itchy ear cannels and low and behold, I’m not the only one. Unbelievable that they still still these or haven’t attempted to correct the issue. My ears are constantly itching, and especially at night. I’ll never put those things back in my ears.

    I have been having issues since I started using my Galaxy Buds2 Pro(Graphite.) I would use one earbud at a time, once my ear got irritated, itchy, and flaky I would use my other earbud. After 2 months of irritation and occasional fluid oozing out of my ear I finally got an ear infection. The pain is awful, so much so that I missed a day of work. I want to know what we can do as many people are being affected by this. I would really like compensation, also I am worried that this will have lasting affects like some of the other comments on here. I have pictures and medical records, what is the next step?

    I normally don’t use earbuds, but for about two weeks now I started using them and now I have itching, crusts in my eat and major liquid drainage. I’m seeing the doctor about it but the only thing I’ve change is using these earbuds.

    I have been waiting on this case to move forward. I had the burning and my fluid issue was middle ear and because of the pressure I caused the tinnitus in my ears to echo or get louder! 2 years later i have accepted the fact this this ringing will not go away! I can’t hardly hear my kids speak to me. If I’m washing my hands I have to turn the water off because everyone sounds like they are mumbling.
    My wife and I argue much more now because it’s annoying having to ask her to repeat her self 3 times for almost every thing she says to me.

    In fact, the ringing is so loud I can hear it driving down the highway going 70+ over the road noise!

    Unreal how nothing has happened yet!
    Ive already contacted the same lawyer mentioned here. We have email records of info just waiting. I too would like some justice for this inconvenience.

    Oh my goodness. I was just looking for over ear pods. I had terrible flaking, itching swelling from the day I bought these. I just had a terrible infection and needed antibiotics. This is terrible that Samsung continues to sell these and for so much money too. I have to get over ear ones because changing the tip doesn’t help.

    Wow…I had no idea what was going on until this morning. I had just gotten to the point that my ears were feeling ‘better’ and seemed to be healing and then I wore them this morning to run and oh my goodness…they are so mad…red, raw, oozing and painful. I said today…it has to be those Samsung ear buds! I can’t believe they are still selling these things with the number of adverse events that people are experiencing! Please include me as well!

    I too was just googling why my ears hurt so bad after wearing earbuds for just a little while and ran into this. My ears get scabs in them anytime I wear them and I don’t wear them often. I’ve had them for about a month and I’ve never felt the pain I feel with them and I’ve had earbuds before but they have been wired and never gave me issues.
