Lenovo defect class action lawsuit overview:

Lenovo manufactures and sells a desktop with hardware and software defects that cause the device to frequently freeze and/or crash, a new class action lawsuit alleges. 

Plaintiff Luis Lucero claims Lenovo’s Legion T5 28IMB05 desktop computer contains NVIDIA audio and graphic drivers that are believed to not be compatible with the device’s other drivers, software, and components. 

Lucero argues the alleged incompatibility causes the Lenovo desktop to frequently freeze and crash, in contrast with marketing that the device will “function reliably, not freeze or crash, and run smoothly during operation subject to normal use.” 

“Despite users’ expectations the Product would function reliably for games, graphic design, and other everyday use without freezing or crashing, hardware and software defects have prevented this,” the Lenovo class action states. 

Lucero wants to represent a California class and multi-state consumer fraud class of individuals who have purchased a Lenovo Legion T5 28IMB05 desktop during the statutes of limitations for each cause of action alleged. 

Lenovo has failed to categorized Legion T5 desktop as defective, says class action

Lucero argues Lenovo has compounded the problem by allegedly failing to categorize that the Legion T5 28IMB05 desktop has a defect, which prevents consumers from being able to obtain warranty coverage. 

Further, while Lucero says Lenovo did attempt to fix his computer after he contacted them with a support ticket, he argues “the repair was short-lived, as the freezing and crashing restarted” and he was “left to deal with a near-unusable Product yet again.” 

“Consumers expect a computer represented – directly or indirectly – as capable of functioning reliably, not freezing or crashing, and running smoothly during operation, to act as promised,” the Lenovo class action states. 

Lucero claims Lenovo is guilty of unjust enrichment, fraud, and negligent misrepresentation, and of violating the Magnuson Moss Warranty Act, and California’s Unfair Competition Law, False Advertising Law, and Consumers Legal Remedies Act

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and punitive damages for himself and all class members. 

A separate class action lawsuit was filed against Lenovo last month over claims the company manufactures a defective LED smart clock that fails to deliver on its represented performance capabilities.

    I purchased the exact Lenovo desktop from Costco. I have had the issue of freezing and none of the troubleshooting via Costco and Lenovo have helped.

    I’m experiencing identical problems with my model, also purchased from Costco. It’s frustrating not being able to use it as intended. Despite attempting the Lenovo driver fix and refreshing the computer with a new Windows 11 install, the issues persist – freezes and crashes are still a constant annoyance.
