Lenovo defect class action lawsuit overview:

  • Who: Luis Lucero filed a class action lawsuit against Lenovo (United States) Inc.
  • Why: Lucero claims Lenovo’s Legion T5 28IMB05 desktop contains a defect that causes it to frequently freeze and/or crash.
  • Where: The class action lawsuit was filed in California federal court.
  • What are my options: Try Microsoft for alternative desktop products.

Lenovo manufactures and sells a desktop with hardware and software defects that cause the device to frequently freeze and/or crash, a new class action lawsuit alleges.

Plaintiff Luis Lucero claims Lenovo’s Legion T5 28IMB05 desktop computer contains NVIDIA audio and graphic drivers that are believed to not be compatible with the device’s other drivers, software, and components.

Lucero argues the alleged incompatibility causes the Lenovo desktop to frequently freeze and crash, in contrast with marketing that the device will “function reliably, not freeze or crash, and run smoothly during operation subject to normal use.”

“Despite users’ expectations the Product would function reliably for games, graphic design, and other everyday use without freezing or crashing, hardware and software defects have prevented this,” the Lenovo class action states.

Lucero wants to represent a California class and multi-state consumer fraud class of individuals who have purchased a Lenovo Legion T5 28IMB05 desktop during the statutes of limitations for each cause of action alleged.

Lenovo has failed to categorized Legion T5 desktop as defective, says class action

Lucero argues Lenovo has compounded the problem by allegedly failing to categorize that the Legion T5 28IMB05 desktop has a defect, which prevents consumers from being able to obtain warranty coverage.

Further, while Lucero says Lenovo did attempt to fix his computer after he contacted them with a support ticket, he argues “the repair was short-lived, as the freezing and crashing restarted” and he was “left to deal with a near-unusable Product yet again.”

“Consumers expect a computer represented – directly or indirectly – as capable of functioning reliably, not freezing or crashing, and running smoothly during operation, to act as promised,” the Lenovo class action states.

Lucero claims Lenovo is guilty of unjust enrichment, fraud, and negligent misrepresentation, and of violating the Magnuson Moss Warranty Act, and California’s Unfair Competition Law, False Advertising Law, and Consumers Legal Remedies Act

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and punitive damages for himself and all class members.

A separate class action lawsuit was filed against Lenovo last month over claims the company manufactures a defective LED smart clock that fails to deliver on its represented performance capabilities.

  1. Rick says:

The exact same thing happened to me with the same Lenovo model. Company claims they don’t know what’s going on but I e seen THOUSANDS of comments on Lenovo s website where other people have ALL had the same problem. Time to hold this predatory company accountable. All they had to do was not use faulty motherboards, which they KNOW are faulty .

    1. Rick says:

Also, I need to mention the common trend is, these massive failures occur exactly when the purchase warranty expires, within 2 weeks before or after. Amazing coincidence right?

  2. spencer says:

i bought 2 of these computers for me and a close friend. i had use lenovo before and they have had their issues like everyone else.. right?.. my computer worked fine, but my friends instantly was freezing off the start to which we thought was just a issue with drivers or what not. then after my warranty was void mine started to have issues. so i was contacting lenovo for support, to which they were no help AT ALL, and they sent me to windows. windows tried to fix the problem with multiple screen controlling sessions where they updated my drivers and it would work fine for about 3 days. eventually i learned what windows was doing and replicated it. my graphics card dosnt work on the proper driver. i have to use a driver WAY behind what it requires, or else my computer freezes immediately instead of the half hour, hour, 4 hours, 6 hours, etc.. that it usually takes. not to mention with my friends computer, there is a graphics issue and a memory issue.. how does that even happen. the computer is so bad that it cant access information, store it, or display it. NEVER, EVER, EVER, EVER, EVER.. WILL BUY ANOTHER LENOVO PRODUCT AGAIN. ive had alot of regrets in my life.. but this seriously tops the rest. what a pos.

  3. Jeremy says:

I’ve had similar issue with my lenovo legion desktop. They knowingly sold faulty hardware and I have a device that they have failed to repair or correct. Constant crashes, almost daily, with no help from them at all.

  4. John Zimmerman says:

My Lenovo legion 5 desktop computer, with warranty starting in march 2021 , will freeze within 15 minutes, then restart , or stay off, this Lenovo legion 5 desktop has been doing this from the first day of use to the present day today Dec. 20/ 2023

  5. Mike Maynard says:

These comments describe exactly what is happening to my Costco purchase of a Legion T5-28IMB05- Freezes and crashes and can not update GPU drivers. Has happened constantly since about a year post-purchase.

  6. Aaron Murphy says:

I have this computer and have had the same issue since the first time a driver was updated. Lenovo wouldn’t warranty it and just told me to not do updates, which is ridiculous. I want in on the lawsuit. I live in Montana. There is another class action lawsuit in Michigan for this same problem (Josh Dinwiddie v Lenovo). I reached out to the attorney’s office handling that as well.

  7. vicki says:

    add me

  8. Jason Llewellyn says:

I also have the same model and issues. Also bought from Costco. I’m tired of not being able to use the damn thing, as intend. I’ve tried the Lenovo driver fix, doesn’t work. I’ve tried to refresh the computer with a new Windows 11 install. Nope, still freezes and crashes.

  9. Chris says:

Bought this for gaming but what a hunk of junk since I bought it from Costco. Constant freezing out of nowhere. Sometimes happens within one minute of turning computer on and other times takes 30-60 minutes. Probably never buying a Lenovo product again.

  10. Chris Graff says:

I would like to join this lawsuit. I wish I would have known about it prior to my purchase of a DT Legion T5 26IOB6. Within 3 days, it started to freeze, restart, and lose video for no apparent reason. Lenovo has had it in for repairs twice and it is still having the same issue. Worse, when I received my system back the second time, the rear panel screws were stripped out and there is a dent in the case. So, essentially, they made things worse. It’s a great system on paper….shame the reality does not match.
