Molson Coors Beverage Company USA is facing a class action lawsuit in New York claiming the company is falsely advertising the ingredients in its Vizzy Mimosa Hard Seltzer.

Mimosas traditionally contain champagne and orange juice; the Vizzy Mimosa Hard Seltzer contains no champagne, the class action says.

Instead, the drink includes ingredients such as sparkling water and generic alcohol, according to the ingredient list.

“Even if purchasers find and read the ingredients, they will be misled because it lists only ‘Alcohol’ instead of truthfully identifying its source as not from champagne, but sugar or another fermentable source, such as ‘Alcohol (from fermented sugar),’” the Vizzy mimosa lawsuit says.

Vizzy Mimosa is instead a malt beverage, the equivalent of drinking a flavored beer, the lawsuit claims.

Because of advertising that makes consumers believe the drink includes champagne, the Vizzy Mimosa Hard Seltzer’s are sold at a premium price of approximately $17.99 for a 12 pack of 12-ounce cans and $3.49 for one 24-ounce can, excluding tax and sales.

That price is higher than the cost for similar products that don’t include misleading marketing, the Vizzy seltzer lawsuit claims.

The class of New York purchasers is asking for monetary damages and attorneys’ fees 

Earlier this year, Molson Coors Beverage Co. agreed to a $9.5 million class action lawsuit settlement to resolve claims its Vizzy hard seltzer products were misleadingly labeled as having “antioxidant vitamin C from acerola superfruit.”
