Summer’s Eve Benzene Class Action Lawsuit Overview:
- Who: Natalie Lofaro filed a class action lawsuit against Prestige Consumer Healthcare Inc.
- Why: Lofaro claims Prestige fails to disclose that some of its Summer’s Even brand Ultra Freshening sprays contain the chemical benzene, a known human carcinogen.
- Where: The class action lawsuit was filed in New York federal court.
Prestige Consumer Healthcare fails to disclose that some of its Summer’s Eve brand Ultra Freshening sprays contain the chemical benzene, a known human carcinogen.
Plaintiff Natalie Lofaro claims Prestige misleads customers by not including benzene in its ingredients list,-while running a “deceptive” and “false” marketing and advertising campaign catered toward health-conscious consumers.
Lofaro wants to represent a nationwide class of consumers and a New York subclass of consumers who purchased the affected Summer’s Eve brand Ultra Freshening sprays.
She says she purchased Summer’s Eve Ultra Freshening Feminine Deodorant Spray without being aware that it contained benzene, rendering it “worthless.”
Lofaro claims she was thus injured in fact and financially as a result of purchasing the product.
“Had Defendant not made the false, misleading and deceptive representations and omissions regarding the Product containing benzene, Plaintiff would not have been willing to purchase the Product,” the class action lawsuit states.
Benzene Can Cause Health Issues Such As Anemia and Cancer, Agencies Report
The Centers for Disease Control and Prevention say benzene exposure can cause “severe health issues such as anemia, immune system damage and cancer,” according to the lawsuit.
The International Agency for Research on Cancer and the National Toxicology Program, meanwhile, have also determined that benzene is carcinogenic to humans, Lofaro says.
“Defendant’s concealment was material and intentional because people are concerned with what is in the products that they are putting onto and into their bodies,” the lawsuit states.
In addition to Lofaro’s own research, a study by Valisure LLC, an independent analytical pharmacy, found the Summer’s Eve brand Ultra Freshening sprays contain benzene, according to the lawsuit.
Lofaro claims Prestige is guilty of breach of express warranty, breach of implied warranty of merchantability, unjust enrichment and fraudulent concealment and is in violation of New York General Business Law.
A number of other class action lawsuits have been filed over allegations of benzene exposure in products, including against Procter & Gamble, Bayer and Suave, among others.
