NissanA new settlement could provide repair benefits to Nissan drivers whose vehicles are equipped with what customers say is a defective engine.

Nissan agreed to settle the engine defect class action lawsuit instead of taking it to court in an effort to avoid the costs and risks of further litigation.

Though the settlement presents less risk, court documents indicate that the repair benefits offered to Class Members will cost Nissan around $6 million in total. 

In October 2016, drivers filed the class action lawsuit alleging that certain vehicles possess a defective engine. Allegedly, there are defective parts in the timing chain systems in the engines that can cause the engine valves to have too much slack. This problem then in turn causes the chains to hit other parts of the engine and damage them, according to drivers.

The plaintiffs say that the defect can cause a range of problems, including loud noises, and even catastrophic engine failure that can put drivers and others in danger.

Customers argue that the company violated both federal and Massachusetts consumer protection laws by selling defective vehicles. Allegedly, the company knew of the problem but did not attempt to warn customers or fix the issue.

The plaintiffs also said that the company had breached its contract and express warranty, and was unjustly enriched by the sale of the defective vehicles.

Nissan tried to fight these claims, and moved to dismiss in May 2017. This motion was rejected in 2018, but some claims were trimmed from the engine defect class action lawsuit.

Drivers filed for Class certification in late 2018. Class Members include consumers in Oregon, Texas, North Carolina, Colorado, New York, Maryland, Florida, and New Jersey who purchased certain Nissan vehicles produced in the middle to later end of the last decade. Vehicles included in the proposed Class are the Altima, Quest, Pathfinder, Xterra, and Frontier vehicles.

These consumers may be able to benefit from the proposed Nissan class action settlement. The settlement will not only cover this class action lawsuit, but a separate one filed in the Eastern District of New York over similar issues.

The company has agreed to extend the vehicle warranties from 60,000 miles to 120,000 miles for affected vehicles, along with providing repair reimbursements. Though the total amount of the settlement was not stated, estimates indicate that the total value of repairs and reimbursements for repairs already performed is around $6 million, with each repair or reimbursement worth around $1,500.

    I purchased in 2018 a Titan xd cummins.At about 65,000 my def pump failed. It was gonna cost $1500.I had to pay $500. Then at 91k my turbo actuator began to fail.Traded it in to same dealer but it cost me a lot of time and my trade in was awful..23k. I feel they didnt test the cummins trucks out enough prior to sale.I feel imo they rushed them into the market.Many more are realizing this we need reparations.

    I have 2012vnissan quest and was recently told I may need to replace engine, it smokes. I have 115,00 miles. Put 10,00 miles on it. Oil was was changed regular I have receipts.

    I am in Az I own a 2010 maxima with a bad transmission . I am without a vehicle now because I cannot pay the 5,000 dollars to fix it . How do we file a claim and get Nissan to fix all nissans with CVT problems . Need help please

    I have a 2013 Nissan Murano. I called to complain to Nissan when after 5 years paying it off it needed a 5K fix that was a known issue. They refused to cover. I am still driving the vehicle but have noticed stuttering and lack of response to acceleration. It is sporadic and I believe it is the transmission. Not sure the best way to proceed as I am almost at 160k miles and I am sure no warranty or extension will cover. Very disappointed since my Toyota Prius got 250k miles and most of my Subarus got at least 180k before I traded them in.

    What about the states that arent listed? Shouldn’t the class include all states? I have one of the listed vehicles as well. A previous lawsuit excluded my vehicle as it only pertained to the vehicles with the 2.5L engine. However, all of Nissan motors have the timing guide and tensioner problem, to include the 3.5L, 4.0L and Infiniti 3.5L and 3.7L. All of which owned by family and all have the same problem. After thounds in repairs mine has found its final resting place in the south 40.

    I just purchased a 2013 Nissan Murano SV in Phoenix AZ June of 2020 and our vehicle broke down the end of September 2020. The Nissan dealership service dept called us stating we had Motor Failure due to the radiator busting. There was a weird sound we heard when we first got the Murano that sounded like a belt and it would only make the sound when the A/C was turned on. We filed a claim with Nissan Consumer Affairs and we were denied for any help with reimbursement cost and we were quoted by the servicing dept that cost would be around 14k to fix and we paid about 11k cash for the Murano. Is there any help out there that we can get? It is really unfortunate when you buy a car from a Nissan dealership trusting that the vehicle would be reliable way longer than 3 months and now we have a rental car we have to pay for from another dealership where we towed our vehicle to. We were also told to tow the vehicle to the dealership we purchased the vehicle from so they can see if they will be able to help but we feel helpless and we feel like Nissan took advantage of us. The Warranty wouldn’t even cover our damage so if anyone could please help or assist us with any information that could give us any support, we would really appreciate it.
