NissanA new settlement could provide repair benefits to Nissan drivers whose vehicles are equipped with what customers say is a defective engine.

Nissan agreed to settle the engine defect class action lawsuit instead of taking it to court in an effort to avoid the costs and risks of further litigation.

Though the settlement presents less risk, court documents indicate that the repair benefits offered to Class Members will cost Nissan around $6 million in total. 

In October 2016, drivers filed the class action lawsuit alleging that certain vehicles possess a defective engine. Allegedly, there are defective parts in the timing chain systems in the engines that can cause the engine valves to have too much slack. This problem then in turn causes the chains to hit other parts of the engine and damage them, according to drivers.

The plaintiffs say that the defect can cause a range of problems, including loud noises, and even catastrophic engine failure that can put drivers and others in danger.

Customers argue that the company violated both federal and Massachusetts consumer protection laws by selling defective vehicles. Allegedly, the company knew of the problem but did not attempt to warn customers or fix the issue.

The plaintiffs also said that the company had breached its contract and express warranty, and was unjustly enriched by the sale of the defective vehicles.

Nissan tried to fight these claims, and moved to dismiss in May 2017. This motion was rejected in 2018, but some claims were trimmed from the engine defect class action lawsuit.

Drivers filed for Class certification in late 2018. Class Members include consumers in Oregon, Texas, North Carolina, Colorado, New York, Maryland, Florida, and New Jersey who purchased certain Nissan vehicles produced in the middle to later end of the last decade. Vehicles included in the proposed Class are the Altima, Quest, Pathfinder, Xterra, and Frontier vehicles.

These consumers may be able to benefit from the proposed Nissan class action settlement. The settlement will not only cover this class action lawsuit, but a separate one filed in the Eastern District of New York over similar issues.

The company has agreed to extend the vehicle warranties from 60,000 miles to 120,000 miles for affected vehicles, along with providing repair reimbursements. Though the total amount of the settlement was not stated, estimates indicate that the total value of repairs and reimbursements for repairs already performed is around $6 million, with each repair or reimbursement worth around $1,500.

    2010 Altima. CVT issues diagnosed by outside repair shop. Was told by Nissan to take to dealership for consideration. Failed to tell me about diagnostic fee. Nissan diagnosed the same problem (CVT issues) at 126,000. Denied me since it cut off at 120,000. Made me pay the diagnostic fee and left me SOL. Nissan was unwilling to help and BBB claim filed. Nissans response to this “known” issue (as stated by corporate representative is appalling. Please add me to this.

    I bought a 2019 q50 redsport with 49 miles that has never drove straight. The issue was addressed 4 days after tge purchase. I have now replaced tge tires 3 times had a cracked rim several alignments and now replacing the fuel rails for the high pressure fuel lines leaking gas, the steering knuckle, lower control arm all from the defective lower control arm bushing that is leaking due to failing. Nissan has breached my warranty by the dealerships first saying the car is set up to drive this way then saying damage was due to a pothole than it was from me hitting curbs and now that the dealership has to document its the bushing leaking its now from a collision. My car has never been in a collision. My mechanics kept saying the lower control arm bushing has to much play and nissan said they dont care about independent shops service records. I have dealt with this for a year and 8 months now and has cost me over 3k this time around. Every q50 i was given for a loaner has a slight pull to the right. This is from the defective bushing in the lower control arm. My nephew purchased a 2017 q50 a week ago and has the same symptoms as my 2019 and tge dealership says its the back rotors which we replaced and did not fix it. This is another defect nissan is trying to get out of by blaming the consumer for the damage.

    I bought my 2009 Nissan Altima from a used car dealership this year. I am making payments to the dealer and still owe over $3000 and the cvt issue with Transmission is so loud it is ready to seize. I drive for my job and cant even drive the car and its Thousands of dollars to fix it. It has 180,000 miles so I am totally screwed!! The class action only covers up to 120,000.

    Add me please. I have a 2005 Nissan Altima that the transmission and motor had to be replaced. I also have a 2011 Nissan Altima that has the CVT transmission that’s causing issues.

      I have a Nissan Maxima 2005 in Florida. I had to replace engine after they couldn’t figure out what was wrong and totally messed up my electrical and computer system which needed to be repaired. It cost about 3000 dollars. Do I have any recourse? I have the documents for the work done. I spent so much money and they had my car for months that I cancelled my driver’s insurance and now anywhere I look it’s at least 300$ per month and I live on 821$ per month as a disabled woman.
