NissanA new settlement could provide repair benefits to Nissan drivers whose vehicles are equipped with what customers say is a defective engine.

Nissan agreed to settle the engine defect class action lawsuit instead of taking it to court in an effort to avoid the costs and risks of further litigation.

Though the settlement presents less risk, court documents indicate that the repair benefits offered to Class Members will cost Nissan around $6 million in total. 

In October 2016, drivers filed the class action lawsuit alleging that certain vehicles possess a defective engine. Allegedly, there are defective parts in the timing chain systems in the engines that can cause the engine valves to have too much slack. This problem then in turn causes the chains to hit other parts of the engine and damage them, according to drivers.

The plaintiffs say that the defect can cause a range of problems, including loud noises, and even catastrophic engine failure that can put drivers and others in danger.

Customers argue that the company violated both federal and Massachusetts consumer protection laws by selling defective vehicles. Allegedly, the company knew of the problem but did not attempt to warn customers or fix the issue.

The plaintiffs also said that the company had breached its contract and express warranty, and was unjustly enriched by the sale of the defective vehicles.

Nissan tried to fight these claims, and moved to dismiss in May 2017. This motion was rejected in 2018, but some claims were trimmed from the engine defect class action lawsuit.

Drivers filed for Class certification in late 2018. Class Members include consumers in Oregon, Texas, North Carolina, Colorado, New York, Maryland, Florida, and New Jersey who purchased certain Nissan vehicles produced in the middle to later end of the last decade. Vehicles included in the proposed Class are the Altima, Quest, Pathfinder, Xterra, and Frontier vehicles.

These consumers may be able to benefit from the proposed Nissan class action settlement. The settlement will not only cover this class action lawsuit, but a separate one filed in the Eastern District of New York over similar issues.

The company has agreed to extend the vehicle warranties from 60,000 miles to 120,000 miles for affected vehicles, along with providing repair reimbursements. Though the total amount of the settlement was not stated, estimates indicate that the total value of repairs and reimbursements for repairs already performed is around $6 million, with each repair or reimbursement worth around $1,500.

    I own a 2014 nissian Rogue is nothing but headaches!! The transmission, headlights, takes on water in the floorboards and under dash, windows fail to operate, lets not mention the engine codes that keep displaying and the faulty instrument panel along with gps and radio. This car is a nightmare on wheels, please add me as I cant risk putting my family at the wheel of this car anymore!!!!

    I would like to be part of this law suit .. I have a 2017 Nissan Pathfinder with 54,000 miles never had one problem till recently my check engine light came on.. 430 code came up which is the catallac converter .. the dealer at vision nission said I needed a new engine but clearly said they could flush my engine for 1200 .. they also never fixed my anti lock brake recall which is safety feature.. and put my family at risk.. i did not have a extended warranty but Nissan consumer affairs which told me to get a second opinion which I tried but they said Nissan they won’t cover anything .. the voided my warranty for everything on my vechicle..

      I would too I have a faulty sensor and I shouldn’t have to pay for it there’s a lot wrong with my car that shouldn’t have been

    I bought a used Nissan Frontier about 6 months ago ( Nov 2021). In Dec. as I was getting ready to reverse into my driveway, the engine suddenly surged, racing.. Luckily I was in Neutral. After it settled down I backed up and parked. I took it into our local Nissan to have them check it and find out what had happened. They could find nothing wrong, so I chalked it up as a fluke and thought nothing more of it. Until Feb. 21st. I was on my way to work and everything was going ok. Suddenly, the truck was speeding on ice and we flew across 5 lanes of traffic. I didn’t make the ditch. I hit another truck head- on and continued up the highway until I got it to stop by slamming it into Park. The engine was screaming.!!! I don’t know what the RPM’s were, but it was high. I had to turn the key off to stop it. After everything settled down, I got in touch with Nissan NAmerica, told them what had happened. Eventually they had an inspection done and came up with the report that there was nothing wrong with the engine..!!! I beg to differ. I have numerous reports from other owners where this exact problem happened to them with the same results from Nissan. Someone is going to get killed if Nissan is not held accountable ( if there hasn’t been a death already)…I would like to be included in the lawsuit with these people. I would love to be face-to-face with them. They are responsible for the defects their products have and are still pushing them onto our hiways. I could have killed the other driver and I will live with that for the rest of my life. I want Nissan to take ownership of this. My first accident in driving for 65 years and it will be my last …

    My 2015 Nissan Versa Note was just past 60,000 miles when I bought her in July 2018. I thought she was a great find and even bartered for a better deal. Winter 2018 I need a new transmission as I drive from Springfield to Bloomington-Normal and my car decides to stop working. I was in nursing school, living paycheck to paycheck min. wage jobs, barely enough credit to get by, and trying to get from my clinical an hour away to my other clinical site that morning when my only form of long distance transportation gave up on me. That’s sad. Truly. Replaced the transmission, June 2021, tranmission acts up again as I’m coming from Champaign to Bloomington-Normal. Car can’t go past 2 rpms, I’m slowing down into a town and everything stops. I park in a small town in front of a stranger’s home, I turn the car on again and blast the heat to cool off the car as an attempt to make it home. Drive around the block and seems to be okay so I drive another 20 minutes home. Replace the fuel, add a fuel cleaner. Works for a bit then again does the same thing. I have not driven this vehicle in months and I’m still paying for car insurance. Thankfully I’m with someone who owns two cars and is good with cars. Replaced spark plugs, car temporarily works until I go out of town and come back again October 2021 same thing. He says its the transmission and I told him I already replaced it! I have sworn off Nissan and will curse them until the day I die. Forgot to mention my sistwr’s fiancé got a Nissan Sentra 2013 before I warned him. Months later his transmission is bad. This is dangerous and unnacceptable.

    I have owned several Nissan Muranos (2003 and 2016) in the past and experienced no problems. I purchased a 2010 Nissan Murano in July, 2021. The dealership that I purchased my vehicle from failed to mention the problems with the CVT transmission and now, I’m stuck with a car that hesitates when accelerating and at times, shakes. Unfortunately, I have discovered that I am outside the 10 year/120k mile extended warranty. To add insult to injury, when I called the Nissan dealership in Athens, GA, the customer service representative advised that he knew exactly what was wrong with my car and that there was nothing they could do to help me which prompted my google search with finding out exactly what was going on with my car. This is not how Nissan USA should be doing business!

    I have a 2019 Nissan Sentra with the cvt transmission and it is giving me problems and also my emergency control braking system sensor that has gone out and is going to cost me $1,800 to replace that I do not have. This car is less than a year and a half old and should not be having this issue. Upon looking on Nissan’s complaints this affects over 800,000 cars on the road today. And I feel like I should not have to pay for something that is only a year and a half old.

    I have a 2013 Nissan Maxima. In 2019, I brought my Maxima to the dealer as the transmission felt “off”. Twice they said nothing was wrong. Now, in 2021 with 109,000 miles, my transmission failed, and I had to replace it for $5300. Nissan said “there is nothing they can do since the car is out of warranty”. Please add me to the lawsuit.

    Hi I have a 2010 Rogue, current miles 92900, it needs a new transmission again! 1st CVT went out at 44200. I live in Az. Please let me know if my Rogue qualifies or which suit I can join.

    I have a 2011 Nissan Murano that has full CVT transmission just failureI
    8/16/2021. To fix cost $5000 new transmission, i have found out after the fact of the settlements in regards to the CVT’s in most Nissan vehicles. My nissan falls under the extended warranty of 10 years/120k miles which ever comes first but Nissan dealer told my car no more warranty. Please add me to this settlement
