Mazda Fuel Pump Defect Class Action Lawsuit Overview: 

  • Who: Tamerlane T Bey II filed a class action lawsuit against Mazda Motor of America and Denso Corporation. 
  • Why: Bey claims Mazda and its parts supplier, Denso, knowingly exposed drivers to a “dangerous” fuel pump defect. 
  • Where: The class action lawsuit was filed in New York federal court. 

Mazda knowingly exposed hundreds of thousands of its customers to a dangerous fuel pump defect that could cause their vehicles to stall, shut down or fail to start, a new class action lawsuit alleges. 

Plaintiff Tamerlane T. Bey II claims Mazda, along with its parts supplier, Denso, created a “substantial risk of injury and death for any person operating or riding in a vehicle equipped with the defective fuel pump.” 

Bey claims Mazda and Denso were aware of the fuel pump defect “for years” but failed to disclose the problem to its customers until November 2021, at which time the auto manufacturer initiated a recall. 

“Mazda admits it knew about the Fuel Pump Defect as early as March 2019. Nevertheless, Mazda failed to make public the existence of the Fuel Pump Defect until November 12, 2021, over two years later,” the Mazda class action states. 

Mazda Issued A Foreign Recall More Than A Year Prior To U.S. Recall, Class Action Claims

In November 2021, Mazda issued a recall for the 2019 CX-3, 2018-2019 CX- 5, 2018-2019 CX-9, 2019-2020 Mazda2, 2018 Mazda3, 2018 Mazda6 and 2018- 2019 MX-5, according to the Mazda class action. This came more than a year after the automaker had conducted a foreign recall for the same issue. 

Denso, meanwhile, had previously issued a recall for its fuel pumps in April 2020, according to the Mazda class action. 

Bey argues that a fuel pump is supposed to last for the “life” of a vehicle and is “critically important” to its overall operation. 

Denso, despite issuing its recall, failed to “take any corrective action itself” and passed the issue off to “vehicle manufacturers,” the lawsuit says. 

Bey claims Mazda and Denso are guilty of breach of express warranty and implied warranty of merchantability, among other things, and in violation of, among other things, California’s Consumers Legal Remedies Act and the state’s Song-Beverly Consumer Warranty Act. 

Bey wants to represent a nationwide class and California subclass of current and former owners or lessees of a Mazda vehicle containing a defective fuel pump. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with actual and statutory damages for himself and all class members.

    I had 2004 Mazda B300 that had a faulty fuel pump relay switch, it kept shutting down while I was riding down the road. We bypassed it and soldered to keep it feom happening again.
