General Motors Airbag Class Action Lawsuit Overview: 

  • Who: GM truck and SUV owners lodged a class action lawsuit against General Motors LLC. 
  • Why: Plaintiffs claim GM trucks and SUVs manufactured in the year 1999 to the present contain a defective airbag deployment system. 
  • Where: The class action lawsuit was filed in a New Jersey federal court. 

GM trucks and SUVs manufactured between 1999 and the present contain a defective airbag deployment system that puts the lives of its drivers at risk, a new class action lawsuit alleges. 

Lead plaintiffs William J. Endress, Lee Ford, Gary Clark, and Ira Bondsteel claim General Motors knows about but fails to address the defect, which keeps airbags and/or seatbelts from properly deploying in the event of an accident. Plaintiffs want to represent a nationwide Class of consumers, along with New Jersey, Michigan, and Texas subclasses, who bought or leased GM trucks or SUVs manufactured during or after the year 1999. 

Airbag, Seat Belt Failures in Popular GM Trucks, SUVs

There have been more than 800 complaints to the National Highway Traffic and Safety Administration (NHTSA) regarding airbag and/or seat belt failures during frontal accidents involving GM trucks and SUV’s, in addition to thousands of fatalities and injuries since 1999, according to the class action lawsuit. 

Plaintiffs claim General Motors intentionally omits, suppresses, and conceals information and material facts about the defective airbag deployment system from consumers.

“Despite their knowledge of the Defect and its impact on safety, Defendants have concealed the Defect and failed to recall or repair the Class Vehicles, presumably to avoid the significant costs and inconveniences of recalling and/or repairing millions of vehicles,” states the class action lawsuit. 

Endress, Ford, Clark, and Bondsteel accuse General Motors of fraud by concealment, unjust enrichment, and in violation of the New Jersey Consumer Fraud Act, Michigan Consumer Fraud Act, and Deceptive Trade Practices Act Tex. Bus. & Com

Plaintiffs are demanding a jury trial and seeking damages and injunctive and declaratory relief for themselves and Class Members. 

Class action lawsuits in regard to General Motors allegedly defective airbag deployment system have also been filed in California and Michigan this month.

    I was recently in an accident in a 2013 Chevy Silverado I was run off the road and over a hill where I hit a tree head on My air bags never deployed but as hard as I hit they should have I am now suffering a back injury where I have a fractured spine

    I was in a accident on February the tenth of 2024 an my airbags didn’t deploy nor did my seat belt lock up when I hit a tree now I have spinal compression or cracks I believe if my safety features would have worked properly I wouldn’t be in this pain

    1995 GMC Sierra 1500 air bags and seat belt restraints failed after impact with a guard rail head on at 55mphs,filed complaint with gm whom escalated to esis whom tried use the repose defense which I don’t see how this class action is able under those means. I did find a statue of mediation which they replied with the repose statue which states intial user has ten years from purchase , or 2 years within date of discovered injury or defect. I rebuttle back to esis that I was not the intial user but the secondary user and A would applily to my situation not B of the intial/original owner and they did not reply after.

    My dad has a 2007 GMC Sierra 2500 4×4 with duramax. Air bags deployed while vehicle was parked in the garage while he slept. They were going to fix it but no longer make the wiring harness under the drivers seat which was determined to be the cause of the deployment. Maybe the airbags are not the issue maybe it’s their own electrical issue causing the airbags to go off. After all his airbag went off while truck was not running and parked in the garage. Now he has to drive a vehicle that the seat will no longer move and the safety features mandated by the NTSB don’t work any longer on his truck.
