Pep Boys auto parts and tires store frontA new Pep Boys class action lawsuit says customers who bought tires from the store failed to receive federally-required registration forms or have the tires registered at the time of purchase.

The Pep Boys class action lawsuit argues that customers who buy a tire that ultimately comes under a recall might experience challenges due to the information that should have been captured and transmitted to the tire maker at the time of the consumers’ purchase.

According to the Pep Boys tires class action lawsuit, federal laws require that with each tire sold, the buyer of those tires receives a paper registration form with the contact information of the tire dealer and an identification number for each and every tire sold.

Furthermore, the Pep Boys class action lawsuit argues that the retailer failed to transmit these details to the tire manufacturer either in electronic or paper form.

The class action lawsuit against Pep Boys explains that if and when a recall happens, the tire manufacturer takes the information captured by the retailer and uses it to notify consumers of the recall status and next steps. Without the contact information of the buyer, the manufacturer cannot easily reach the buyer of any affected tires.

According to the Pep Boys class action lawsuit, millions of tires were sold to Class Members without the proper registration process.

The Pep Boys auto class action lawsuit argues that the conduct of the defendants was harmful to consumers because of the failure to allow for a few extra minutes to collect these contact details.

The Pep Boys class action lawsuit says that because of these actions, buyers of the tires did not receive the full benefit of the products they paid for.

Further, the Pep Boys auto class action lawsuit claims that these actions by omission give tire buyers the impression that they will be reached if and when necessary due to a new tire recall.

The Pep Boys tires class action lawsuit points out that tire recalls are a serious issue since 3.2 million tires were recalled from 2009 to 2013 with many of those drivers not even being aware of the recall status.

The lawsuit explains that tire registration is an important part of the purchase process since it generates a list of all the consumers to be reached in the event of a problem.

The National Transportation Safety Board states that only around 10 percent of the tires sold by independent dealers are ever registered and only one in five are returned to the manufacturer in a traditional recall situation.

The Pep Boys class action lawsuit seeks injunctive and declaratory relief and monetary damages for Class Members who bought tires from the retail chain.
