Dodge Ram Gas Guzzling Class Action Lawsuit Overview: 

  • Who: FCA US LLC and Cummins Inc have asked a judge to reject certifying a class action lawsuit lodged by Dodge Ram owners. 
  • Why: FCA and Cummins claim the truck owners who claim their vehicles consume excess amounts of fuel rely on last minute and unproven theories in an effort to achieve Class certification.
  • Where: The class action lawsuit is pending in Michigan federal court.

Dodge truck owners who claim in a class action lawsuit they overpaid for gas guzzling vehicles are facing arguments by Fiat Chrysler (FCA) and engine manufacturer Cummins Inc against Class certification. 

FCA argues the drivers don’t have proof they overpaid for the vehicles and are using last-minute and unproven theories to try and achieve Class certification. 

The automaker points specifically to drivers’ new claims that the Dodge Ram trucks contain an “excessive emissions device” — something it argues does not exist.

“Having abandoned their pleaded theory of a ‘defeat device,’ Plaintiffs now rely on a theory the Class Trucks are equipped with a ‘device’ they contrived out of thin air,” FCA said. 

Dodge Ram Trucks Falsely Advertised, Claims Class Action Lawsuit

Drivers claim the Dodge Ram trucks they purchased were rigged to use excessive amounts of fuel and emitted an illegal amount of pollutants.

Further, drivers allege the companies committed breach of contract and violated the Racketeer Influenced and Corrupt Organizations Act.

FCA, meanwhile, argues a number of factors influence a drivers’ decision to purchase a Dodge Ram truck and that there is no way to separate how to calculate “overpayment” for a used vehicle versus a new one. 

“Plaintiffs were not exposed to the same amount or type of advertising, they had different Monroney labels on their trucks, they held varying views on the importance of emissions in deciding to buy, and they (had) different beliefs as to whether their trucks meet represented and expected fuel economy,” FCA said. 

In addition to the excessive fuel usage claims, drivers are arguing they paid extra for features associated with clean vehicles and were continually harmed by problems such as excessive soot accumulation. 

Drivers also argue that the vehicles were designed to operate differently during regulator tests than during real world driving conditions. 

A separate class action lawsuit was filed against FCA last month by drivers who allege they overpaid for Dodge muscle cars built with rear differentials that are prone to exploding.

    I bought a 2019 5.7l etorque 50k miles. Noticed on fill up it would say 260 to empty. I tried everything to get better mileage nothing worked avg per tank 10-12mpg. I took it in to be serviced. Loaner truck w/o Etorque averaged 18.76 mpg. Picked my truck up this week first fill up 241 to empty 9mpg. Sign me up.

      Please include my 2020 bighorn average 8-9 mpg since I purchased it with only 7 miles on it in October 2020 over 50k$$$

    I bought a new RAM in 2021 due to advertised better fuel economy over my 2019 GMC, and paid for e-torque. This things get worse than my GMC, and no where near the window sticker17/23!! Doesn’t average 17 on highway!

      Same story with me. 2021 Hemi e-torque and getting about 12mpg combined.

    Yep. Sticker reads average of 19 with etorque. Probably a huge deciding factor when paying more for the upgraded Limited. Getting about 13 mpg around town. Went up to 15.2 on 2 hour trip, after clearing mpg counter. Not cool, and evidently a lie.

      2020 ram 1500 limited w/etorque. No check engine lights just 12.5 mpg highway better in the city due to the eco mode will hold. I moved from diesel to this model to improve from the 12 mpg my diesel was consistently getting.

    I am at a ram dealer right now as FCA said to take it in due to my complaint of sticker gas mileage showed combined 19 mpg on my 2021 ram rebel that I am getting 13 mpg, I paid over 60k for this vehicle in confidence of the sticker estimate gas mileage, they just checked the truck out and say no problems, this is totally false advertising and I will join any class action law suite for this issue. This is my 5th ram and you would think in 2021 you should never see any truck getting 13mpg, they are being dishonest in there claims and need to be held accountable.

    Yes please do;!! 2015 ram 1500, gasoline. Right now (1/29/2022) to fill up on reg. 87 gasoline costs @ $60 guesstimate, I travel to and fro work daily mileage is 98 miles, so before I can come home from work the NEXT day my gas light is on and I have to buy more gasoline.
    Now, let me mention dodge ram 1500 fuel tanks..
    I don’t know if it’s just happening to my truck, but have had it 4 years, it’s had 40k miles when I bought from the Dodge dealership, in the 4 years I have had to replace 6 fuel pumps, the dealerships wouldn’t warranty a faulty fule pump that had been covered already at the time before, so have spent WELL near $ 1000 out of pocket!

    Add please,Dodge Ram 2018 burns 140$ in gas within 4hours of highway driving,absolutely ridiculous

    Does anyone else have their screen state that there mopar/uconnect is Panasonic Software????
    I’ve gone to the site and it isn’t available…..
    Been a victim of fraud, and curious if this software on truck is even legit

    Yes!! My Dodge Ram truck absolutely uses alot of gas! I spent $106 in gas today just to fill it up. It burns gas like crazy. Doesn’t get very many MPG.

      Does your uconnect/mopar screen say it’s Panasonic software???
      Went to google so called Panasonic software site for Ram,and it doesn’t exist???
      Hoping a fellow owner can give me insight on this,
