UPDATE:

  • On Jan. 14, 2020, Class Members in a lawsuit against Sirius XM Radio asked a federal judge for final approval of a class action settlement worth $32.4 million arising from claims that the satellite radio service violated the Telephone Consumer Protection Act.

Sirius XM has agreed to pay $25 million and provide free services as a part of a recent TCPA class action settlement.

The settlement will benefit all individuals who received call from Sirius XM despite having been put on the National Do Not Call Registry over 31 days prior or on SiriusXM’s internal Do Not Call List.

Individuals need to have received more than one telemarketing call from Sirius XM in a 12 month period between Oct. 16, 2013 and April 26, 2019.

Plaintiff Thomas Buchanan filed his class action lawsuit against Sirius XM in March 2017. According to Buchanan, Sirius XM called consumers for telemarketing purposed despite some consumers being on the National Do Not Call Registry and the company’s own internal do not call list.

Buchanan argued that these calls violated the Telephone Consumer Protection Act (TCPA). The TCPA is a federal law that helps to protect consumers from harassing telemarketing practices. The act includes protections from calls in  which consumers have placed themselves on the National Do Not Call Registry or a company’s do not call list.

Sirius XM has not admitted any wrongdoing but has agreed to settle the class action lawsuit. The settlement notes that “the proposed Settlement does not mean that any law was broken or that Sirius XM did anything wrong.” Instead, a settlement allows the claims to be resolved without the stress, costs, and risks of a trial.

Under the settlement, Class Members can receive three months of access to Sirius XM’s All Access Subscription package or a cash payment. The cash payments are estimated to be around $12.

In order to receive a cash payment, Class Members need to file a valid claim by Oct. 8, 2019. In order to receive free service, Class Members need to file a valid claim by Dec. 22, 2019.

The deadline for exclusion and objection is Oct. 8, 2019. The final approval hearing for the settlement is scheduled for Nov. 7, 2019.

  1. David says:

    add me to please

  2. Christine Gagliardi says:

Have been unable to cash or deposit check for $38.45, no place to sign check. Left message on 800-452-3837 option 4. Appears this settlement is fraudulent, who keeps the money for uncashed checks?

  3. Halisha says:

I opted for the free 3 mths subscription. I have purchased a new car since then and now they will not let me transfer my free service to my new car. This sucks!

  4. Stan says:

For everyone whose check expired before you could cash it. You need to call 1-800-452-3837 and press option 4 to leave a message stating your need a check reissued, don’t forget to leave a callback number.

    1. Lisa says:

I could not cash this check either and now it is expired. I called and left a message.
The check was only valid for a short time to begin with and during this pandemic where normal
services are not available to all of us, I feel they deliberately did not want us to get this money.
Plus, sending it on a postcard which my bank wouldn’t cash.

    2. Erica Wallace says:

They told me weeks ago they were sending out new ones still haven’t received that new one

    3. Wes says:

The check didn’t come until after the deadline to cash. Now the phone number is no longer working!

  5. Tiffany Pustka says:

I too received a bad check and want to know the next steps to resolve this issue.

  6. estelle klein says:

same as all above….cannot cash check thru teller machine. i just received it and it’s now expired….what are the options?

  7. Kristin Carr says:

I’m having the same problem as everyone else! The check has expired (after 6 weeks??!) and neither of my banks would accept it. There is no Citibank near me and I would like an explanation why we were all given bogus checks??

  8. Richard Marinelli says:

I could not cash the check. How do I get a valid check that I can cash? It has now expired too. What check has only 6 weeks until it expires??

  9. Diana Salvon says:

I received my check but I have been unable to cash the check and it expired on 8/10/2020. My bank states the there is no place to sign it on the back. How will this be rectified?

  10. Rachel Lenhardt says:

I was not able to cash my check, I tried at another local bank again just yesterday and they would not take it and now it is expired. Is there another way to be paid or can it be re issued on a regular check?
