  • On Jan. 14, 2020, Class Members in a lawsuit against Sirius XM Radio asked a federal judge for final approval of a class action settlement worth $32.4 million arising from claims that the satellite radio service violated the Telephone Consumer Protection Act.

Sirius XM has agreed to pay $25 million and provide free services as a part of a recent TCPA class action settlement.

The settlement will benefit all individuals who received call from Sirius XM despite having been put on the National Do Not Call Registry over 31 days prior or on SiriusXM’s internal Do Not Call List.

Individuals need to have received more than one telemarketing call from Sirius XM in a 12 month period between Oct. 16, 2013 and April 26, 2019.

Plaintiff Thomas Buchanan filed his class action lawsuit against Sirius XM in March 2017. According to Buchanan, Sirius XM called consumers for telemarketing purposed despite some consumers being on the National Do Not Call Registry and the company’s own internal do not call list.

Buchanan argued that these calls violated the Telephone Consumer Protection Act (TCPA). The TCPA is a federal law that helps to protect consumers from harassing telemarketing practices. The act includes protections from calls in  which consumers have placed themselves on the National Do Not Call Registry or a company’s do not call list.

Sirius XM has not admitted any wrongdoing but has agreed to settle the class action lawsuit. The settlement notes that “the proposed Settlement does not mean that any law was broken or that Sirius XM did anything wrong.” Instead, a settlement allows the claims to be resolved without the stress, costs, and risks of a trial.

Under the settlement, Class Members can receive three months of access to Sirius XM’s All Access Subscription package or a cash payment. The cash payments are estimated to be around $12.

In order to receive a cash payment, Class Members need to file a valid claim by Oct. 8, 2019. In order to receive free service, Class Members need to file a valid claim by Dec. 22, 2019.

The deadline for exclusion and objection is Oct. 8, 2019. The final approval hearing for the settlement is scheduled for Nov. 7, 2019.

Who’s Eligible

All individuals who received more than one telemarketing call from Sirius XM in a 12 month period between Oct. 16, 2013 and April 26, 2019 despite having been put on the National Do Not Call Registry over 31 days prior or on SiriusXM’s internal Do Not Call List.

Potential Award

$12 or three months of free access to Sirius XM’s All Access Subscription package.

    I finally received my check two days before the cash date and it states it can’t be reissued after the cash date. However I have NO CITI BANK BRANCHES within an hour driving distance. So not only have I been given a check that doesn’t have a back to sign but I also don’t have a way of cashing it.

    I received my check but I have been unable to cash the check and it expires on 8/10/2020. My bank states the check is too thick, there is no place to sign it on the back. I would appreciate it if you would email me and I can send the check back for a new check. We have no Citibanks in our area.

    This will be my third post regarding the check in the amount of 38,45. This check is a bogus check. I can not cash the check or deposit it. I tried going to the drive thru and also going into the bank and talking with a teller. I also tried to deposit it through my banks ATM. I was told that the check could not be validated. I have been getting the runaround from both Sirius XM and CITIBank. I only have until 8/20/2020 to cash this check. I need someone to get contact me about resolving this check issue.

    I have made numerous phone calls regarding the bogus check that I received in the amount of 38.45. This check is useless. I tried to cash it as well as deposit the check into TD bank both in person and drive thru as well as trying to deposit the check through the ATM machine. Every time I was told the the check could not be validated and that I should contact CITI Bank. There are no CITI bank branches anywhere in my area. I tried calling CITI Bank but they were of no help. I was told to contact Sirius XM. When I contact Sirius I am told to contact CITI Bank. All I get is a runaround. The check has to be cashed by 8/10/2020 and I am running out of time. Can someone please contact me regarding this matter.

    I hope someone contacts me via email to let me know how they are planning on handling this matter. Looks like there maybe a future class action suit if people are being charged a return fee on their check..

    I received a check in the amount of $38.45 on a postcard check. I told the check to my TD bank in which I have a checking and savings account and they could not cash or deposit the check. The check will not go through their check scanner. I have to 8/10/2020 to cash this check but can’t. There are no CITI bank branches in my area. In fact, I don’t think they have any branches anywhere remotely close to me.

    My credit union will not accept the check and I drove to two different Citibank locations and they will not cash it. What the hell is going on?

    I received my check for $38.45 and deposited it at BOA (Chicago) and just got a notification that the check was not cashed and got billed for a return item fee. What do I do now? Is the check legit?
