  • On Jan. 14, 2020, Class Members in a lawsuit against Sirius XM Radio asked a federal judge for final approval of a class action settlement worth $32.4 million arising from claims that the satellite radio service violated the Telephone Consumer Protection Act.

Sirius XM has agreed to pay $25 million and provide free services as a part of a recent TCPA class action settlement.

The settlement will benefit all individuals who received call from Sirius XM despite having been put on the National Do Not Call Registry over 31 days prior or on SiriusXM’s internal Do Not Call List.

Individuals need to have received more than one telemarketing call from Sirius XM in a 12 month period between Oct. 16, 2013 and April 26, 2019.

Plaintiff Thomas Buchanan filed his class action lawsuit against Sirius XM in March 2017. According to Buchanan, Sirius XM called consumers for telemarketing purposed despite some consumers being on the National Do Not Call Registry and the company’s own internal do not call list.

Buchanan argued that these calls violated the Telephone Consumer Protection Act (TCPA). The TCPA is a federal law that helps to protect consumers from harassing telemarketing practices. The act includes protections from calls in  which consumers have placed themselves on the National Do Not Call Registry or a company’s do not call list.

Sirius XM has not admitted any wrongdoing but has agreed to settle the class action lawsuit. The settlement notes that “the proposed Settlement does not mean that any law was broken or that Sirius XM did anything wrong.” Instead, a settlement allows the claims to be resolved without the stress, costs, and risks of a trial.

Under the settlement, Class Members can receive three months of access to Sirius XM’s All Access Subscription package or a cash payment. The cash payments are estimated to be around $12.

In order to receive a cash payment, Class Members need to file a valid claim by Oct. 8, 2019. In order to receive free service, Class Members need to file a valid claim by Dec. 22, 2019.

The deadline for exclusion and objection is Oct. 8, 2019. The final approval hearing for the settlement is scheduled for Nov. 7, 2019.

Who’s Eligible

All individuals who received more than one telemarketing call from Sirius XM in a 12 month period between Oct. 16, 2013 and April 26, 2019 despite having been put on the National Do Not Call Registry over 31 days prior or on SiriusXM’s internal Do Not Call List.

Potential Award

$12 or three months of free access to Sirius XM’s All Access Subscription package.

    They are still violating the Do Not Call List! I have received calls on two numbers that are on the list. The first time they call I asked them to stop calling.

    Website to submit claim is ironically marked as unsafe in at least Safari and Chrome, so cannot summit.

    I bought a used car with SiriusXM and it had a three month trial. I never could get it to work and when I tried to get help with it they kept asking for a preferred payment card. I finally told them to forget helping me because I was not going to give them a credit card number. Since then I received phone calls and constant junk mail trying to get me to subscribe. Why would I pay for something that never worked on my radio anyway?
