Home Depot TCPA Settlement Checks

In a Home Depot TCPA class action lawsuit, our readers have reported receiving settlement checks in the mail worth as much as $2,441.84. These significant payments resolved claims that Home Depot violated the Telephone Consumer Protection Act, or TCPA, with unsolicited telemarketing calls.

Plaintiffs in the Home Depot class action lawsuit claimed they were hit with a barrage of unsolicited telemarketing calls after signing up for free water tests. Through this signup, Atlantic Water and Air allegedly gained access to Home Depot customer information.

“Home Depot gave Atlantic Water and Air exclusive access to their stores and their logo with the hope of obtaining consumers information,” the TCPA class action claimed.

In June 2019, Home Depot and Atlantic Water and Air agreed to a $4.35 million class action settlement to resolve the claims against them – although neither company admitted any wrongdoing.

Under the terms of the settlement, consumers were eligible for payment if they received an unsolicited robocall from Home Depot or Atlantic Water and Air between Oct. 16, 2013 and June 1, 2015. If these consumers filed a valid claim form by Sept. 20, 2019, they would be eligible for cash payments of up to $5,000. Actual payments ended up being $2,441.84 – far above the estimated payments of $110.

The Home Depot TCPA Class Action Lawsuit is Manopla, et al. v. Home Depot USA Inc., et al., Case No. 3:15-cv-01120, in the U.S. District Court for the District of New Jersey.

Norcold RV Refrigerator Checks: Round Four

TCA readers have also reported received settlement checks worth $113.69 in a Norcold RV refrigerator class action settlement. These checks represent the fourth and final round of settlement checks from the deal.

Plaintiffs in the Norcold RV refrigerator class action lawsuit claimed they purchased Norcold refrigerators for their RVs which had a defective unit. Allegedly, the refrigerators’ cooling unit caused the boiler tubes to corrode and leak flammable gas. As a result, consumers were reportedly at an increased risk of fire in their RVs.

Although Norcold did not admit any wrongdoing, the defendants agreed to pay $36 million to resolve the claims against them. According to the settlement terms, claims for personal injury or wrongful death were not included in the settlement.

The settlement benefitted individuals who own or previously owned a Norcold 1200 Series gas absorption refrigerator or cooling unit that was made between Jan. 1, 2002 and Oct. 1, 2012.

Additionally covered by the settlement were consumers who own or owned a Norcold N6 Series gas absorption refrigerator or cooling unit, or a Norcold N8 Series gas absorption refrigerator or cooling unit, that was manufactured between Jan. 1, 2009 and Dec. 31, 2013.

In addition to providing cash payments in four separate rounds, the settlement provided extended warranties for individuals who owned N6 or N8 series gas absorption refrigerators.

The Norcold Class Action Lawsuit is Etter, et al. v. Norcold Inc., Case No. 8:13-CV-0081-JLS-RNB, in the U.S. District Court for the Central District of California.

SiriusXM TCPA Settlement Checks

Top Class Actions readers have also reported receiving settlement checks of $38.45 in a third settlement. The settlement resolves claims that SiriusXM violated TCPA with unsolicited calls.

Plaintiffs in the SiriusXM class action lawsuit claimed they received calls from the radio provider despite registering their numbers with the National Do Not Call Registry. This list, which is established by TCPA, allows consumers to register their numbers in order to not receive telemarketing calls.

The deal was set to benefit all individuals who received at least one telemarketing call from SiriusXM in a 12 month period between Oct. 16, 2013 and April 26, 2019, despite being on the National Do Not Call Registry over 31 days prior or on SiriusXM’s internal Do Not Call List.

If these consumers filed a claim by Dec. 22, 2019, they would be eligible for the payments recently received by our readers in the form of settlement checks.

The SiriusXM TCPA Class Action Lawsuit is Buchanan v. Sirius XM Radio Inc., Case No. 17-cv-00728-D, in the U.S. District Court for the Northern District of Texas.
