American Web Loan has agreed to resolve claims that the online lender violated interest rate laws.

A $141 million settlement has been reached to resolve claims that online lender American Web Loan violated loan interest laws.

The settlement deal benefits individuals who obtained a loan from American Web Loan between Feb. 10, 2010, and June 26, 2020.

Plaintiffs in the American Web Loan class action lawsuit claimed that the online lender violated federal law by issuing loans without the authority to do so. The lender allegedly used their status under the Otoe-Missouria Tribe of Oklahoma to issue loans with high interest rates which would otherwise be prohibited under state laws.

However, according to the plaintiffs, American Web Loan can’t skirt state interest rate laws simply because of their tribal affiliation.

“American Web Loan is not a legitimate arm of the tribe and tribal sovereign immunity does not shield American Web Loan or any other defendants from liability in connection with the unlawful online payday lending scheme,” the American Web Loan class action lawsuit argued.

The online lender hasn’t admitted any wrongdoing but has agreed to resolve the claims against them in a settlement valued at $141 million. The online lender has agreed to forgive 45,305 loans totaling $76 million and fund a $65 million cash fund.

Under the terms of the deal, Class Members will have their loans cancelled as disputed debt and adjusted to a zero balance. American Web Loan will reportedly request that Clarity Services, the applicable credit reporting agency, delete any credit reporting associated with the cancelled loans.

The settlement will also provide cash payments. Class Members who had a loan issued between Feb. 10, 2010 and Dec. 31, 2011 will receive flat payments of $20 or a proportional share of the settlement cash fund – depending on the documentation provided with their claim.

Other Class Members who had loans issued between Jan. 1, 2012 and June 26, 2020 will receive a proportionate share of the cash fund – not a full refund of paid interest.

Class Members who had loans issued between Jan. 1, 2012 and June 26, 2020 are not required to file a claim form to benefit from the settlement. However, Class Members whose loans were issued between Feb. 10, 2010 and Dec. 31, 2011 must file a valid claim form by Nov. 3, 2020 in order to benefit form the settlement.

Claim forms require Class Members to provide a copy of the loan agreement; a copy of a bank statement evidencing the receipt of an American Web Loan loan or a repayment withdrawal in connection with such loan; and/or an email from AWL indicating that a loan application was approved and that funds were being released. If more documentation is provided, payments may be higher.

The deadline for exclusion was Aug. 10, 2020 and the deadline for objection is Sept. 21, 2020. The final approval hearing for the American Web Loan class action settlement is Oct. 21, 2020.

Who’s Eligible

Individuals who obtained a loan from American Web Loan between Feb. 10, 2010 and June 26, 2020.

Potential Award

Cash payments and loan forgiveness.

Consumers can check their eligibility for payments on the settlement’s known Class Member portal. A notice ID and the last four digits of a Class Member’s Social Security number is required to check this portal.

Proof of Purchase

A copy of the loan agreement; a copy of a bank statement evidencing the receipt of an American Web Loan loan or a repayment withdrawal in connection with such loan; and/or an email from AWL indicating that the loan application was approved and that funds were being released.

If more documentation is provided, payments may be higher.

      Estimated payment was 498 and received an email today that actual payment is 454.65. I opted for the Mastercard option about an hour ago and the website indicates it might take 24-48 hours to receive payment although in “most cases” it arrives instantly. Mine did not come instantly so, I’ll just keep waiting I guess.

      I just accepted my $281.04 payment in MasterCard they say it will take 24-49 hours.

      Also, you can elect the paper payment, but you will have to wait till all the digital payments have gone out.

          I received my payment coming soon 10/4 received digital payment ready today 10/24 but also said it’s not available for 24-48 hours, I thought it would be instantly. I was debating on going with the paper check option but was afraid it would take a year with how slow their process is. But thankfully I received my emails and payment will come soon.         Hey Edwin, when your digital payment arrives click the accept my payment button and it will bring you to the paywall. Click on the ? in the upper right hand corner and one of the options will read What if I want a paper check? Follow the instructions from there. It also states paper checks can’t be issued until the digital process is completed, which they say will take several weeks.

    Got my payment today. Was supposed to get $66, got $86. In Tier 1. Should have got a whole lot more considering I paid off the loan well before the conclusion of the Civil case. I hope everyone gets their payment. Talk to you all on the next one.

    I got my payment today. I was estimated at $208 & received $155. I had 3 options, virtual Mastercard, Amazon, or Target card. I took the Mastercard & transferred the money from it to a Serve card, without paying any fees. I got my original email on 10/9/21 & the payment today.

    Update from my parents lawyer. And I say this without a smile but yes the lawsuit and how they are handling it are all in order. But he did say they we basically got screwed and our best option was to opt out and sue indidually. Now with that being said they still have to follow state laws and when he called and talked to the awl lady to confirm they are following the rules. He claimed that the lady kept trying to go around the questions or divert to a different topic. With that being said and he said this without being part of my legal counsel at the moment but basically since they are still technically breaking the law of the state’s if I were to take out another loan and block awl from taking money from my account. Let’s say I borrow $2000 and my first payment to them is $300 Nd the second one the next week will also be $300 so He said go to the bank after the second draft from the account and block them from taking more. They can’t come after you technically and you can hire me no cost to fight them for you. So basically he told me a legal way to steal from them back and prove they are stealing from people still. Maybe we shouldn’t be as bad as them though.
