American Web Loan has agreed to resolve claims that the online lender violated interest rate laws.

UPDATE 2:

  • Top Class Actions viewers reported this settlement paying out up to $119.46 as of late October 2021.
  • Congratulations to everyone who filed a claim and got paid!

UPDATE:

  • On April 7, 2021, the Court preliminarily approved the revised American Web Loan settlement.
  • The updated claim deadline for pre-2012 loans through the online lender is July 9, 2021.

A $141 million settlement has been reached to resolve claims that online lender American Web Loan violated loan interest laws.

The settlement deal benefits individuals who obtained a loan from American Web Loan between Feb. 10, 2010, and June 26, 2020.

Plaintiffs in the American Web Loan class action lawsuit claimed that the online lender violated federal law by issuing loans without the authority to do so. The lender allegedly used their status under the Otoe-Missouria Tribe of Oklahoma to issue loans with high interest rates which would otherwise be prohibited under state laws.

However, according to the plaintiffs, American Web Loan can’t skirt state interest rate laws simply because of their tribal affiliation.

“American Web Loan is not a legitimate arm of the tribe and tribal sovereign immunity does not shield American Web Loan or any other defendants from liability in connection with the unlawful online payday lending scheme,” the American Web Loan class action lawsuit argued.

The online lender hasn’t admitted any wrongdoing but has agreed to resolve the claims against them in a settlement valued at $141 million. The online lender has agreed to forgive 45,305 loans totaling $76 million and fund a $65 million cash fund.

Under the terms of the deal, Class Members will have their loans cancelled as disputed debt and adjusted to a zero balance. American Web Loan will reportedly request that Clarity Services, the applicable credit reporting agency, delete any credit reporting associated with the cancelled loans.

The settlement will also provide cash payments. Class Members who had a loan issued between Feb. 10, 2010 and Dec. 31, 2011 will receive flat payments of $20 or a proportional share of the settlement cash fund – depending on the documentation provided with their claim.

Other Class Members who had loans issued between Jan. 1, 2012 and June 26, 2020 will receive a proportionate share of the cash fund – not a full refund of paid interest.

Class Members who had loans issued between Jan. 1, 2012 and June 26, 2020 are not required to file a claim form to benefit from the settlement. However, Class Members whose loans were issued between Feb. 10, 2010 and Dec. 31, 2011 must file a valid claim form by Nov. 3, 2020 in order to benefit form the settlement.

Claim forms require Class Members to provide a copy of the loan agreement; a copy of a bank statement evidencing the receipt of an American Web Loan loan or a repayment withdrawal in connection with such loan; and/or an email from AWL indicating that a loan application was approved and that funds were being released. If more documentation is provided, payments may be higher.

The deadline for exclusion was Aug. 10, 2020 and the deadline for objection is Sept. 21, 2020. The final approval hearing for the American Web Loan class action settlement is Oct. 21, 2020.

    4. ML says:

I got the email payment coming soon on 10/5 and received my payment on 10/21. Be aware that the virtual debit mastercard can only be used to make purchases. Even if you request a physical card from the issuer, you can’t withdraw cash. I spoke to customer service handling the claims, they were informed differently. Hopefully when your payment comes in, you get an option of PayPal, my payment options were only virtual debit mastercard, targert and amazon.

      1. Tara says:

How long did it take you to receive the virtual MasterCard?
I just received the payment, opted for virtual MasterCard…but it says processes in 24-48hrs…still waiting! Just hope it actually shows up in my email

  3. Mike says:

How about a poll. If you have received the email to claim your payment reply “yes”. Also indicate how long between the coming soon email & the payment email. It seems very few have actually been paid yet from this group.

    1. Barbara Perkins says:

I have not received an e mail Can someone let me know who sends out the e mail is it AWL that sends it out.

      1. Oma says:

  5. RS says:

Has anyone accepted there payment and if so is there a check option??

    1. adriana says:

i accepted my payment & chose the master card option & added it to my apple wallet.

      1. Mike says:

        Adrina:

Was your payment as much as expected? I’ve heard some are way less than anticipated from the portal online.

        1. adriana says:

          i was told i was getting back $120 & i got $98.

      2. Jane says:

        Hi Adriana,
I don’t mean to repeat the question but I’m just curious to know if there’s some timeline from when you received the payment coming soon email to when you actually received email for payment. I don’t know if it’s random or if they are starting off from the lower amounts to higher ones. Your response is much appreciated. Thanks!

        1. adriana says:

i got the “payment coming soon” email 10/10/21 & the “payment is ready” email yesterday 10/21/21 :)

    2. adriana says:

      there’s no check option

    3. AR says:

There is a check option depending on your return amount but they won’t be issued until after all digital payment go out. You can email them once you get your email about payment ready.

    4. ML says:

this is not cool, only way you can get cash is if you do a check option. the digital mastercard is only for purchases and even if you request a plastic card, it will not work at the ATM. I got this info from the company who issues the virtual mastercard. what a bad deal.

      1. mj says:

If you have a pay pal offer as I have you can then transfer to your bank

  6. Joey says:

Hey, Jillian don’t worry, I agree with you. It doesn’t hurt to have someone close check it out. Even if it’d just to help. Let us know if there is anything interesting.

  7. Jillian says:

Sorry. I’ve read a couple other people’s stories on here and it seems they prey can prey upon anyone. Teens, adults, doesn’t matter. I may not have been a kid when I got affected by this scam. But seeing some people comment that we shouldn’t have taken the loan to begin with are obnoxious and don’t know what they are talking about. Like why are you even here, your obviously not p*ss*d at the company like you should be. It sounds like some people won’t be able to recover because of what happened. I think we all had one good reason or another for why we needed some money for help. Soif I’m taking It a bit far by having a close legal counsel help me because I think the ones handling this case are handling this one badly it sounds then yes I’ll deal with it. If it’s nothing and we are just commenting bull***t then I’ll leave it be. But I don’t know who’s handling our stuff. This is some people’s life savings that got taken. I’m gonna help fight for them too. As I said I’ll let you know what I know in a few days. Maybe by then we will all have our money and it will be nothing.

  8. Jillian says:

For the people complaining about my legal counsel. I took out my loan 5-6 years ago and payed back $2000-3000 on top of what borrowed from awl. I never said we were broke or whatever. Actually I signed up for a few loans to put down for a car and awl was first and faster to say yes. But they were scammy that’s why I was accepted so easily. I never told my family until after it went to court. They have been in lawsuits before since they owened a resteraunt they were forced to change things. Yet awl can keep giving out bad loans with bad interest rates and were wandering why they couldn’t pay even close to a real amount but they can keep making loans. And also my parents lawyer won’t charge me just to look at the documents to sum them up and to reassure we are actually freaking out for nothing. He will get back to me in a few days.

    1. Jennifer says:

It’s no one’s business what your situation is

  9. Edwin says:

JJ Wentworth its my money and i wanted now?

  10. Edein says:

Telly let me telly you something F_CK OF?
