A $141 million settlement has been reached to resolve claims that online lender American Web Loan violated loan interest laws.
The settlement deal benefits individuals who obtained a loan from American Web Loan between Feb. 10, 2010, and June 26, 2020.
Plaintiffs in the American Web Loan class action lawsuit claimed that the online lender violated federal law by issuing loans without the authority to do so. The lender allegedly used their status under the Otoe-Missouria Tribe of Oklahoma to issue loans with high interest rates which would otherwise be prohibited under state laws.
However, according to the plaintiffs, American Web Loan can’t skirt state interest rate laws simply because of their tribal affiliation.
“American Web Loan is not a legitimate arm of the tribe and tribal sovereign immunity does not shield American Web Loan or any other defendants from liability in connection with the unlawful online payday lending scheme,” the American Web Loan class action lawsuit argued.
The online lender hasn’t admitted any wrongdoing but has agreed to resolve the claims against them in a settlement valued at $141 million. The online lender has agreed to forgive 45,305 loans totaling $76 million and fund a $65 million cash fund.
Under the terms of the deal, Class Members will have their loans cancelled as disputed debt and adjusted to a zero balance. American Web Loan will reportedly request that Clarity Services, the applicable credit reporting agency, delete any credit reporting associated with the cancelled loans.
The settlement will also provide cash payments. Class Members who had a loan issued between Feb. 10, 2010 and Dec. 31, 2011 will receive flat payments of $20 or a proportional share of the settlement cash fund – depending on the documentation provided with their claim.
Other Class Members who had loans issued between Jan. 1, 2012 and June 26, 2020 will receive a proportionate share of the cash fund – not a full refund of paid interest.
Class Members who had loans issued between Jan. 1, 2012 and June 26, 2020 are not required to file a claim form to benefit from the settlement. However, Class Members whose loans were issued between Feb. 10, 2010 and Dec. 31, 2011 must file a valid claim form by Nov. 3, 2020 in order to benefit form the settlement.
Claim forms require Class Members to provide a copy of the loan agreement; a copy of a bank statement evidencing the receipt of an American Web Loan loan or a repayment withdrawal in connection with such loan; and/or an email from AWL indicating that a loan application was approved and that funds were being released. If more documentation is provided, payments may be higher.
The deadline for exclusion was Aug. 10, 2020 and the deadline for objection is Sept. 21, 2020. The final approval hearing for the American Web Loan class action settlement is Oct. 21, 2020.
Who’s Eligible

A copy of the loan agreement; a copy of a bank statement evidencing the receipt of an American Web Loan loan or a repayment withdrawal in connection with such loan; and/or an email from AWL indicating that the loan application was approved and that funds were being released.

Anyone else been ignored emailing them. Got initial email last year saying getting 125 then havent got another an have emailed them multiple times with no response

This is some bull I tried my target gift card and for me to use it they want to charge my regular master card a fee as a hold. So I emailed them to see if I can change my payment option. Good luck to all.
This is Bullshit. I received less than stated and I want this as cash in my bank account. Why couldn’t they just set up paypal or venmo or a paper check
I just checked my email to see about my payment nothing there, something told me to check my junk mail. I was sent my payment on Saturday and didn’t know it was in my junk mail. I was told I would receive $92.33 but by surprise I received $81.05. My options were Amazon, Target gift cards or digital MasterCard, I chose target gift card and it said my funds will be available 24-48 hours. So if you are waiting for payment don’t forget to also check your junk mail. Good luck
Can I ask what email address your notice came from? I’ve been scouring and monitoring my email folders heavily but still think I may have missed it.
I tried giving the email address out in a reply last week, but my comment was deleted…. it will be from info@mail dot awlsettlement dot com So I’m sure you can figure that out, I was just hoping this will not be deleted by doing it this way.

I was expecting $911.00, but got $1,094. Got my payment for MasterCard within an hour of the email. I paid my electric bill and my daughter’s college rent on-line and both worked fine! Hope others go smooth!

How did you receive them?? As an amazon gift card … does it just show up on your balance or does it download a “form of payment” to your amazon account
Within a few minutes you get a confirmation email from awlsettlement, then I think about an hour later you’ll get another email from them that says that you’ve received a gift card for Amazon. In that email there is a place to click on that says “retrieve my egift now”. It then puts your balance into to your Amazon wallet. I don’t know what happens to anyone that doesn’t already have an Amazon account though.
I got my card…..however it is very limited. I was able to add it to my paypal account, however when ever I tried to use it it was declined. Same way when added to Apple Wallet. Also tried to use it to pay a bill online….declined. Apparently it can only be used to purchase things from certain online sites….really horrible.

Yes! I called the suport number fo rthe card and they said ONLY for online purchases and select in person locations. Can not be used to pay bills etc. or transfer to any cash app.
Oh man, how awful!! I really appreciate this information as I’m suppose to be getting a good chunk back and was planning on the MasterCard to pay bills online. After knowing this I may have to do the Amazon card if available and get groceries. I can’t believe that. Even the tutorial for how to accept payment said the MasterCard could be used anywhere MasterCard is accepted! What a joke.
I used mine to pay some bills including a light bill. Make sure you register the card first on the website with your information and billing zip code.
I’m trying use my MasterCard in store it keeps saying cars not supported? WTF
So I got an email last week saying my payment was ready for a whooping $23, instead of what the first email we recieved said. I took it and did the master card and was able to pay my water bill online no problem. Then tonight I got another email saying my payment is ready or $135, so I went and did the master card again and was able to pay another bill online tonight with that amount. not sure why I got 2 emails with different amounts since I only had one loan with them and the first email back in April said I would only get $99. Not going to argue with the other payment though.

I got my payment email at 5pm on Saturday. It only gave me a Master Card option. I emailed back and asked for a paper check because it was over 1k and I don’t want to shop online for 1k. I am not sure the batch who received the emails this weekend did not have choices of other paymens like the people from last week.
Mine came Sunday and MasterCard was my only option. Mine was also over 1000
I received my final payment for master card option and was able to add the card to my Venmo account. I haven’t used it for payment so I hope it works if I do end up using it for Venmo.
