American Web Loan has agreed to resolve claims that the online lender violated interest rate laws.

UPDATE 2:

  • Top Class Actions viewers reported this settlement paying out up to $119.46 as of late October 2021.
  • Congratulations to everyone who filed a claim and got paid!

UPDATE:

  • On April 7, 2021, the Court preliminarily approved the revised American Web Loan settlement.
  • The updated claim deadline for pre-2012 loans through the online lender is July 9, 2021.

A $141 million settlement has been reached to resolve claims that online lender American Web Loan violated loan interest laws.

The settlement deal benefits individuals who obtained a loan from American Web Loan between Feb. 10, 2010, and June 26, 2020.

Plaintiffs in the American Web Loan class action lawsuit claimed that the online lender violated federal law by issuing loans without the authority to do so. The lender allegedly used their status under the Otoe-Missouria Tribe of Oklahoma to issue loans with high interest rates which would otherwise be prohibited under state laws.

However, according to the plaintiffs, American Web Loan can’t skirt state interest rate laws simply because of their tribal affiliation.

“American Web Loan is not a legitimate arm of the tribe and tribal sovereign immunity does not shield American Web Loan or any other defendants from liability in connection with the unlawful online payday lending scheme,” the American Web Loan class action lawsuit argued.

The online lender hasn’t admitted any wrongdoing but has agreed to resolve the claims against them in a settlement valued at $141 million. The online lender has agreed to forgive 45,305 loans totaling $76 million and fund a $65 million cash fund.

Under the terms of the deal, Class Members will have their loans cancelled as disputed debt and adjusted to a zero balance. American Web Loan will reportedly request that Clarity Services, the applicable credit reporting agency, delete any credit reporting associated with the cancelled loans.

The settlement will also provide cash payments. Class Members who had a loan issued between Feb. 10, 2010 and Dec. 31, 2011 will receive flat payments of $20 or a proportional share of the settlement cash fund – depending on the documentation provided with their claim.

Other Class Members who had loans issued between Jan. 1, 2012 and June 26, 2020 will receive a proportionate share of the cash fund – not a full refund of paid interest.

Class Members who had loans issued between Jan. 1, 2012 and June 26, 2020 are not required to file a claim form to benefit from the settlement. However, Class Members whose loans were issued between Feb. 10, 2010 and Dec. 31, 2011 must file a valid claim form by Nov. 3, 2020 in order to benefit form the settlement.

Claim forms require Class Members to provide a copy of the loan agreement; a copy of a bank statement evidencing the receipt of an American Web Loan loan or a repayment withdrawal in connection with such loan; and/or an email from AWL indicating that a loan application was approved and that funds were being released. If more documentation is provided, payments may be higher.

The deadline for exclusion was Aug. 10, 2020 and the deadline for objection is Sept. 21, 2020. The final approval hearing for the American Web Loan class action settlement is Oct. 21, 2020.

  1. Todd says:

And the fact I had 13 loans with AWL living in a tier 1 state and all I’m getting back is a lousy 359 dollars if I even get that you ripped all of us off

    1. ML says:

no doubt, not good. I guess there will be more reponses like that since it seems like the payments are starting to post.

    2. Toby says:

TODD, I see you complaining a lot here. Did you object to the settlement? Did you exclude yourself from the settlement? Or did you sign your claim form and agree to the terms and conditions like the rest of us did? If it’s the latter, then shut the hell up. You get what you get, just like everybody else. Quit your whining. You had your chance to back out. You chose not too. So suck it up buttercup.

      1. Jenny says:

Toby you must work for AWL somehow

so I just got my email saying my payment is ready blah, blah blah… When we first got the email back in April it said I would get $115. and some change, the email I got this morning said $28.61… what the hell!

      1. Jenny says:

Yes I did. The only options were Amazon, target or master card.

        1. Jane says:

          Hi Jenny,
Just curious when you received the payment coming soon email? Hoping to get an idea of how long it took for payment to go out after that email.
          Thanks!

    3. Toby says:

Jenny, the emails did not say you’d be getting that amount. Reread it and post the exact verbiage here.

      1. Jenny says:

Yeah it said estimate, but that estimate is/was WAY OFF! I’m sure people were expecting close to the amount that they estimated, that is what I was getting at

        1. Jenny says:

Here is the verbiage from the email this morning:

    4. Mike says:

They hired a third party to distribute the payments…I guess they got a big chunk of money also! OUR MONEY!

  4. Shocked says:

Let me guess, you work for AWL?

    1. ML says:

No sir, I just want people to be blessed in their lives. Crazy times right now.

  5. Not Thomas says:

    1. ML says:

Tough crowd, tough crowd. be blessed, people, be blessed.

  6. Thomas Sims says:

    Boooo

    1. Thomas says:

      Boooo

  7. ML says:

Damn, very direct and critical. America 2021.

  8. Jillian says:

Well my family and friends all think that we are being led on. We called and just get vague answers of when payments will be recived. I’ve called through separate days. One said that payments are sent every day since the first Friday of the month. Another said they were sending payments every Friday to a set amount of people until this last Friday which would be the 29th. And I even had one lady say that I might not even recive my payment and have to call back if I don’t see it by the end of the month like what kind of reassurance is that. What if this is just to prevent us from taking more action against us. And on top of that they are still giving out loans as of today. If I’m correct they would be shut down if the lawsuit actually was a thing. Anyways I have my parents who are gonna have a lawyer look at the final agreement and have it better summed up and make sure it’s legal. It looks legal but apparently lots of things can be faked/forged.

    1. Edwin says:

Yes we should of got this money already if they dtarted dending it on friday i really think this is a scam but im not counting on this money anymore

    2. Jimmy says:

I was thinking the same thing….as many people who are following this thread and the number of us who got the “coming soon” email. you would think at least one of us would have gotten paid by now. I think they will send out a massive group on the very last day of the month.

Curious, what is the law that says they have to pay by November 1. I didn’t think there was a time limit on paying out class action suits. Are they bound by a November 1 deadline or is that just based on their statements.

  9. Todd says:

Another day and still nothing pure ( @SSHOLES!!!)

    1. Edwin says:

So i called american web loan to see if i could still get a loan and they said yes and the interest is still the same so can some one tell me if there was a lawswit how can they still do this shit

    2. Marie says:

I think it is interesting that they started sending the money this past Friday yet no one in this group got it. They are sending it daily and no one in this group got it! Not one person. Lol We are from different states and tiers. Unbelievable!

      1. Todd says:

Well if you do the math it states all payments will be received by November 1st given there are over 700 thousand class members that comes out to about 65000 digital payment emails a day

    3. Marie says:

We have to be vigilant and hold them accountable.

    4. Sondra says:

No one is getting anything they lied I know it this is crazy

    5. Your Mom says:

Not a single dollar. They might have until the last business day of the month to send. 140+ million can get thousands a day in interest so, why do the right thing?

      1. Jennifer g says:

Maybe we will need to file suit against them haha

  10. Jimmy says:

When you call the number on the AWL Settlement page now they “imply” that all payments will be issued by November 1. The recorded message says if you do not receive payment by November 1 to call in to the Settlement Hotline.

But that is rapidly approaching and I know of no one who has got a payment yet. Anybody?

    1. jeffery Butler says:

what is the number to call

    2. ML says:

I spoke to someone in customer service around 8:30am central time and was informed that payments were initated on Friday and going forward on a daily basis, Apparently the firm that’s handling the process are on the west coast so to check for your payment email in the afternoon, daily.

    3. Tekyla says:

I haven’t gotten a only a letter dated October 10 my payment is on the way and I will get an email asking how I would like to receive my money.

    4. Barbara Perkins says:

      I have got no email
      No letter
      No nothing
      Has anyone else got nothing
Or am I the only one.

      1. nadya byznus says:

I have gotten nothing as well.
