Woman smiling holding moneyTop Class Actions readers are beginning to receive settlement checks in the mail from three settlements including Alarm.com, Nexus 6P and ComplyRight.

Nexus 6P Smartphone Class Action Settlement

Readers are starting to receive checks for up to $325 in a class action settlement in which Huawei and Google paid $9.75 million to resolve claims that Nexus 6P smartphones had a “bootloop” defect and a “battery drain” defect.

Those customers who purchased a Nexus 6P smartphone between Sept. 29, 2015 and May 3, 2019 qualified for the settlement awards.

The bootloop defect in the Nexus 6P reportedly caused the smartphones to shut down and reboot, and sometimes caused the products to get stuck in a reboot cycle. The defect in the battery caused the smartphones to lose power quicker than normal.

Class Members in this lawsuit can get between $5 and $400 depending on the types of defects they encountered and whether or not they have documentation of their purchase.

The claim form deadline passed on Sept. 3, 2019.

The plaintiffs are represented by Daniel C. Girard, Jordan Elias, Adam E. Polk, Trevor T. Tan, and Simon S. Grille of Girard Sharp LLP, Benjamin F. Johns, Andrew W. Ferich, Zachary P. Beatty, and Beena M. McDonald of Chimicles Schwartz Kriner & Donaldson-Smith LLP.

The Nexus 6P Class Action Settlement is In re: Nexus 6P Products Liability Litigation, Case No. 5:17-cv-02185-BLF, in the U.S. District Court for the Northern District of California.

The data breach from ComplyRight’s website occurred between April 20, 2018 and May 22, 2018 and letters were sent out notifying customers of the breach on July 13, 2018. The letters state that their name, address, email address, phone number, and Social Security number had been compromised in the breach.

The letter sent to Class Members also included an offer for a free year of credit monitoring as well as identity theft protection services.

The plaintiffs in the class action lawsuit claimed that the company did not protect their personal information and did not notify them soon enough after the data breach.

The ComplyRight class action lawsuit was settled in April 2019 when the company agreed to a $3.025 million settlement.

Class Members had three options under the settlement. They could choose from a protection plan, a cash payment of around $50, or up to $200 in expense reimbursement.

The claim form deadline passed on Dec. 6, 2019.

The plaintiffs are represented by Ben Barnow and Erich P. Schork of Barnow and Associates PC; Laurence D. King and Matthew B. George of Kaplan Fox & Kilsheimer LLP.

The ComplyRight Data Breach Class Action Settlement is Winstead v. ComplyRight Inc., Case No. 1:18-cv-4990, in the U.S. District Court for the Northern District of Illinois

Alarm.com Telemarketing Phone Calls Class Action Settlement

TCA readers are notifying us that they are starting to get checks in the amounts up to $2,223.47 from a $28 million settlement related to a class action lawsuit filed against Alarm.com. The class action lawsuit accused the company of placing telemarketing calls to customers’ cell phones without their prior consent.

The plaintiffs claim that the alarm service company, as well as Alliance, a third-party advertiser, placed calls which were in violation of the Telephone Consumer Protection Act (TCPA).

Class Members were expected to get checks starting at $94 with an increase in cash depending on how many valid claims were submitted.

The plaintiffs are represented by Bailey & Glasser LLP, Terrell Marshall Law Group PLLC, Broderick & Paronich PC, and The Law Office of Matthew P. McCue.

The Alarm.com Telemarketing Class Action Settlement is Abante Rooter and Plumbing Inc., et al. v. Alarm.com Inc., et al., Case No. 4:15-cv-06314, in the U.S. District Court for the Northern District of California.

I guess I am going to have to write a letter to the Judge on the case & explain what happened with this check and the fact that no one can even get in contact with the Administrator’s. Also, I just received a denial from my bank ( my bank won’t even cash the check) because it’s been endorsed from when I went to Bank of America to cash it…. I don’t want to keep going through this.

  8. Sgaunna P. says:

Yeah, for whatever reason they’re not answering the phone and right now is when they need to be answering the phone. I’m pissed because I took the check to BofA and they refused to caah it and wrote on the check to return to maker, so basically they destroyed the check and now the administrators won’t even answer the phone and I left them a message and they haven’t returned the call. So, you saw the mail in the informed delivery… So, did I but mines was delivered that same day. You should click where it says to report missing mail on the site.

What does one do if check was lost in the mail? Monday saw letter in informed mail, and never received in mailbox Monday and it’s Friday and still no luck? I heard can take up to 5 days, and it’s been 5 days. I doubt it will ever come. Is there a number I can call or a email address I can contact to talk with the law office about payouts? Thanks in advance.

    1. KRSB says:

Of course I was panicking somewhat, but what I did firstly, was get in contact with my post office. I had went to the USPS website, sent an email through that way, and the confirmation was sent to my email. I actually received an email and call the very next day. They apologized, etc…and asked me do I know where its coming from, and I told him, it was found, and was deliver that evening by mail. Wish you luck with yours and hope this helps.
