Settlement checks worth $45.74 are being received by Top Class Actions viewers who filed claims in the JP Morgan class action settlement alleging unwanted robocalling by the financial institution.
Lead plaintiffs accused JP Morgan of violating the Telephone Consumer Protection Act by peppering consumers with prerecorded messages without their permission.
According to the JP Morgan class action lawsuit, the prerecorded messages left as a part of the robocall marketing tactic concerned debts, including mortgage and home equity line of credit accounts.
The plaintiffs allege that they and others asked JP Morgan to stop calling, and never gave permission in the first place, to no avail.
The JP Morgan TCPA class action lawsuit accused the financial institution of violating federal consumer protection law – the Telephone Consumer Protection Act or TCPA.
The law, enacted in 1991 by Congress, was intended to protect consumers from harassing telemarketing calls, including debt collection calls.
Under the TCPA, companies are prohibited from contacting consumers by phone with marketing messages without express prior consent. Further, companies are not permitted to use prerecorded messages, “robocalls,” to contact consumers.
Fines for companies found to be violating the TCPA are quite steep – between $500 and $1,500 per call. The JP Morgan TCPA class action lawsuit alleged that the bank called more than 200,000 consumers with illegal robocalls.
JP Morgan agreed to pay $2.25 million to settle the class action lawsuit in May 2018.
Class Members in the JP Morgan TCPA class action settlement included those who received prerecorded calls from or on behalf of JP Morgan through the use of an automated dialing system – also prohibited under the TCPA – between April 20, 2012 and March 16, 2018.
Consumers who filed valid claims by Aug. 13, 2018 were expected to receive between $5 and $101.
TCA viewers who submitted claims are now reporting that they have received checks in the class action lawsuit of $45.74.
Under the terms of the settlement agreement, unclaimed funds will be disbursed to two nonprofits, Prosperity Now and New Media Rights.

I file TCPA suits by myself. The smallest settlement I’ve gotten so far is $7,500. The largest is $30,000.
Mr. Blanston,
Hello sir, my name is Candy Henderson. I am very interested in learning more about how you file the TCPA suits yourself, if you would be so kind to do so.
