Top Class Actions viewers report receiving checks in the mail for the Rainbow Light Vitamins, Long Beach telephone tax, Lumber Liquidators flooring, Parking Heater indirect purchasers and Lipozene settlements.

Rainbow Light Vitamins Class Action Settlement

TCA viewers are receiving checks worth as much as $9.50 from the Rainbow Light Vitamins class action settlement.

The makers of Rainbow Light pre- and post-natal vitamins were accused of falsely advertising the product as free of heavy metals in a class action lawsuit. The plaintiffs claimed that independent testing of Rainbow Light products revealed the presence of lead, mercury, cadmium, and arsenic.

The supplement companies admitted no wrongdoing, but agreed to pay $6.75 million to end the litigation. Under the terms of the settlement, Class Members could claim up to $18 for Rainbow Light pre- or post-natal products they purchased.

Claim forms were due in this settlement by July 29, 2020.

The Rainbow Light Vitamins Class Action Lawsuit was Smid, et al. v. Nutranext LLC, et al., Case No. 20L0190, in the 20th Judicial Circuit Court of St. Clair County, Illinois.

Long Beach, California Telephone Tax Class Action Settlement

Checks for up to $92 have been reported in TCA viewers’ mailboxes for the Long Beach telephone tax class action settlement.

The Long Beach telephone tax class action lawsuit alleged the city of Long Beach improperly collected taxes on residents for phone services.

The plaintiffs claimed they and others had been assessed a tax by the city for services, such as teletypewriter exchange services, that were not a part of modern phone services. The plaintiffs accused the city of continuing to collect the tax in direct violation of the Federal Excise Tax and after the Internal Revenue Service (IRS) had ceased collecting the tax in 2006.

The city of Long Beach admitted no wrong doing, but agreed to pay $16.6 million to end the class action lawsuit. The estimated award was up to $46 in tax refunds under the terms of the class action settlement.

Class Members must have submitted their claim forms by Sept. 15, 2018.

The Long Beach Telephone Tax Class Action Lawsuit was McWilliams v. City of Long Beach, Case No. BC361469, in the Superior Court of the State of California in and for the County of Los Angeles.

Lumber Liquidators Flooring Class Action Settlement

Lumber Liquidator flooring class action settlement checks totaling up to $100 have been reported by TCA viewers.

Lumber Liquidators was accused of selling Chinese-made laminate flooring with excessive levels of formaldehyde. In addition, a second class action lawsuit alleged the flooring was not as durable as advertised.

The company denied liability in both lawsuits, but agreed to pay $36 million in a settlement agreement. Under the terms of the settlement, those who purchased Chinese-made laminate flooring from Lumber Liquidators from Jan. 1, 2009, through Dec. 31, 2010, could claim as much as $50. Those who purchased the laminate flooring from Lumber Liquidators from Jan. 1, 2011, through May 31, 2015, could claim a portion of their purchase price.

The claim form deadline was Oct. 20, 2018.

Commercial Truck Parking Heater Indirect Purchaser Settlement

TCA viewers report receiving as much as $384 in parking heater indirect purchaser settlement checks in their mailboxes.

A pair of commercial truck parking heater manufacturers were accused of inflating the prices of their product — a device truckers use to keep the cabin warm when the engine is not running. Both direct and indirect purchasers filed claims over alleged antitrust actions by Espar and Webasto, the manufacturers.

In the indirect purchasers class action lawsuit, the companies agree to pay $7.7 million to end the litigation, without admitting any wrongdoing. Consumers who purchased an Espar- or Webasto-branded parking heater or commercial vehicle with an Espar- or Webasto-branded parking heater between Oct. 1, 2007, and Dec. 31, 2012, could claim a portion of the settlement amount.

The claim form was due Feb. 1, 2019.

The Commercial Truck Parking Heater Indirect Purchaser Class Action Lawsuit was In re: Parking Heaters Antitrust Litigation, Case No. 1:15-mc-00940-DLI-JO, in the U.S. District Court for the Eastern District of New York.

Lipozene Weight Loss Pills Class Action Settlement

Lipozene class action settlement checks worth up to $60 have been received by TCA viewers!

Consumers claimed that the makers of the weight loss supplement Lipozene, Obesity Research Institute, falsely advertised the effectiveness of their product. The class action lawsuit alleged that Lipozene was neither an effective or safe way to lose weight.

The Obesity Research Institute refused to admit any wrongdoing, but paid $4.6 million to end the false advertising claims in a class action settlement agreement. Class Members could claim up to $15 for each bottle of Lipozene they purchased.

The claim form deadline was Feb. 17, 2020.

The Lipozene Weight Loss Pills Class Action Lawsuit was Duran v. Obesity Research Institute LLC, et al., Case No. 37-2013-00048664-CU-BT-CTL, in the Superior Court for the State of California, San Diego County.
