A $7.7 million commercial truck parking heater indirect purchaser settlement has been reached in an antitrust multidistrict litigation against Espar and Webasto.
The lawsuits in the multidistrict litigation alleged that Espar and Webasto conspired together to fix the prices of parking heaters which resulted in consumers being overcharged when purchasing parking heaters or commercial vehicles with parking heaters.
Parking heaters are used in commercial vehicles to keep the cabin of the vehicle warm while the engine is not running.
As part of the settlement, Espar contributed $3.8 million and Webasto contributed $3.9 million for a total of $7.7 million.
The commercial truck parking heater indirect purchaser settlement resolves claims against the companies without determining any wrongdoing or liability.
According to the commercial truck parking heater indirect purchaser settlement website, there is not yet an estimate to how much each Class Member will receive.
Class Members have until Feb. 1, 2019 to submit a valid claim through the settlement website or mail.
Class Members include all consumers who indirectly purchased an Espar- or Webasto branded parking heater or commercial vehicle with an Espar- or Webasto-branded parking heater between Oct. 1, 2007 and Dec. 31, 2012.
Direct purchasers are not included in this parking heater indirect purchaser settlement and instead can file claims through a direct purchaser settlement.
Class counsel can ask for up to one third of the settlement fund for attorneys’ fees plus any costs and expenses, including any incentive payments for Class representatives.
If Class Members wish to exclude themselves from the commercial truck parking heater indirect purchaser settlement, they must have done so by Dec. 1, 2018.
Class Members who fail to exclude themselves and do not file a valid claim will not receive any payment and will also be bound by the court’s decision.
Who’s Eligible
Consumers who indirectly purchased an Espar- or Webasto branded parking heater or commercial vehicle with an Espar- or Webasto-branded parking heater between Oct. 1, 2007 and Dec. 31, 2012. Direct purchasers are not included in the settlement.
Potential Award
Class Members who submit a valid and timely Claim Form will receive an equal portion of the $7.7 million settlement fund after litigation expenses have been paid. The exact amount that each consumer is expected to receive is unknown at this time.
