How to File a Class Action Lawsuit

How Do I Start a Class Action Lawsuit?

If you’ve suffered an injury from a company’s actions (or inactions), you may be eligible to file a class action lawsuit and represent other consumers who have suffered similar harm.

The first step is to find an attorney who is experienced in class action litigation to represent you. Because many defendants in class action lawsuits are large corporations who can afford to pay significant legal fees to defend themselves from litigation, it is important that the attorney you select has the experience and resources needed to bring a strong case.

Does It Cost Me Anything to Start a Class Action?

Most class action attorneys take cases on a contingent fee basis, so you don’t need to pay to participate. Attorneys who work on a contingency basis don’t get paid unless they win the case. After looking into the facts of your class action lawsuit, the attorney will decide whether it is worthwhile to take on.

How Do I Find an Attorney?

When you’re looking for an attorney to represent you in a class action lawsuit, you need to make sure the lawyer is experienced, has a strong record of success and has sufficient resources. Finding an experienced lawyer who is willing to take on your case can be a challenge.

Top Class Actions works with a number of lawyers who have significant experience representing plaintiffs in class action lawsuits. Simply submit your information at our Start a Class Action page to get started. Attorneys in our network will review your case and let you know if you qualify to take legal action. If you qualify, you will be contacted for a free legal consultation.

What Is a Lead Plaintiff?

A lead plaintiff is the person (or group of people) who files the class action lawsuit and is named as plaintiff on the class action complaint. The lead plaintiff serves as the Class representative and therefore must be able to represent the interests of all Class Members.

It is typically necessary for the lead plaintiff to be an active participant after the class action lawsuit is filed. This means appearing for a deposition, hearings, trial, and any other important meetings related to the case. If damages are awarded following a trial or settlement, the lead plaintiff will receive an incentive award for his or her efforts in bringing the case.

I would like to start a class action against Klara and Quad Pay, both are pay in 4 companies. both companies are somehow able to obtain payments from debit cards that I removed from the account. Also after both companies received my bankrupcty Stay Order, they both continued to obtain “normal” payments from my bank accounts.

Walmart online shopping, Walmart plus membership and price gouging. Pop on the website ranges both 12 packs and 24 packs from $18.00 to 41.00 and many with up to an additional 20.00 shipping fee. I know prices range depending on different parts of the country but here in Indiana those prices are not typical. One offer was labeled as a best seller, a 24 pack of big red pop, selling at $40.99. Price gouging for convenience of ordering online for delivery even after paying for a Walmart plus subscription.

I would like to start a class action against Tempest LLC. We purchased a new home with a warranty in a new subdivision. Our one year walk through took 6 months to set up, and we have been in our home now almost 3 years and nothing from our one year walk through has been fixed except one thing that was not completed. There are dozens of new homeowners in our subdivision with the same concerns and they didn’t follow through with the agreement as per our contract when we purchased the home. I have contacted the BBB twice and both times verbally attacked on the website with aggressive statements, false statements, and refusal to accept any responsibility, even when proof was provided. I have dozens just in my subdivision who want to join.

It seems that there’s a class action lawsuit in order here.

Americas Favorite Pet is scamming and deceiving people by running a so-called photo contest where you if you win, you get 10,000 and your pet gets featured on a magazine cover. You can vote for free once a day via Facebook or credit card “verification” or you can ask someone to make a donation and get many votes to move up on their list within your “group”. There is no publicly available information that tells the contestants for each state/region how many total dogs/cats they are competing against, how many groups there are, and how they proceed with eliminations. People who are competing in contest don’t even know what they are up against, how many votes they have or who voted and how many times.

More than that, there are individuals on social media platforms who offer to get you thousands of votes via their many Facebook accounts which basically means that there’s no way to win unless you pay someone for the votes.

Im hoping to find someone who can put a stop to this blatant deception and misrepresentation and shut down this scam of a “contest”.

    Thank you

I would like to start a class action lawsuit against Buffalo Wild Wings for false advertising on their website and in the restaurants. For almost 6 months now I’ve been back and forth with them about how the app does not allow me to log in. All they do is send a robo-email stating the same thing “something went wrong” or “the problem is being fixed” yet they promote the app for obtaining free food when signed in, ordering food, earning rewards, or playing the trivia at the restaurant. I have spoken to the staff at the restaurant as well as other customers and they have also stated that several other customers have had the same issues. It’s false advertising by making people believe they can get free food through the app when it reality the app does not function properly. In a world of advance technology, there is no reason for it unless it’s a ploy to get people in the restaurant to eat and spend money. I think they owe the public for their time and stress of constant promises that come up empty.

I would like to start a class action law suit against Regus LLC. I signed a virtual office contract with Regus LLC in the first part of December 2023. The lease was to begin in February 2024 I ended up losing my job and explained that I needed to break the agreement which has not began yet and they replied that it does not matter the reason, they will persue me for the 12 month lease and I will pay the leagal fees. I searched on line, and there were several others with this same issue with Regus LLC. I reported them to the Better Business Bureau.

In Alabama in apartment complexes you have to sign up an account with (NES) National Exemption Service for your Water Bill. The landlord don’t tell you about the hidden fees that are listed : Water Charge, Sewer Charge, Common Electric Service Charge. We are paying a Sewer Charge that changes every month and also being charged a common electric fee which lights be on all day in the walk ways that we don’t need until it’s night which I don’t think we should be responsible for because we already have a light outside the apartment door that we turn off or on.

In April I was in an no-fault head-on accident and had Young America Insurance they didn’t tell me that they charge a fee for declining the Uninsured Motorist “If I knew I would’ve accepted” The Alabama law states documentation has to be written by the insured instead of signing a document of the rejection.
In fact, Alabama law mandates that all automobile liability policies delivered or issued for delivery in Alabama include uninsured motorist coverage unless such coverage is rejected in writing by the named insured. Ala. Code § 32-7-23. Uninsured motorist coverage is commonly referred to as UM coverage in the industry.
This suppose to be against the Law.

How do I start a class action against Davis inventions. I told them about my idea paid money for years. Then I heard nothing now I see my idea is out there.

I would like to start a class action lawsuit against Upgrade Inc. They are a predatory lender with shady business practices that were not outlined in their agreement contracts. I have brought my account to current several times but they have kept my account in delinquency. I have contacted them in regards to employment changes trying to switch my payment dates, while a representative told me that as long I am not over 30 days late they will not report on my credit. Unfortunately, this was a lie and reported my account delinquent a few days after my first missed payment. They call several times a day from various phone numbers, leave robo voicemails, send fraudulent emails about purchases I have not made. I have to block the numbers because of the volumes of calls and voicemails. I believe they are violating several FTC guidelines and it has affected my credit greatly. I have a proven track record of paying all my bills on time. Credit Karma had suggested this card to me without explaining the true nature of the lender. If I had known that Credit karma was being paid to push these lenders, I would have never signed up for the card. Being younger and not as financially literate as I am today, I followed blindly what credit karma had advised for me. Upon more research, many people have had horrible experiences with Upgrade similar to mine. I just want to settle this debt and remove them completely from my credit report.
