Graphic of gavels falling against a grey background - type class action lawsuit

Class action lawsuits provide the power of strength in numbers. In cases in which there is a pervasive systemic injustice seen that affects many, class action lawsuits can send a powerful message to those who are acting in an allegedly unjust manner.

The type of class action lawsuit filed depends on the allegations a plaintiff is making:

Consumer fraud

Consumer fraud class action lawsuits address instances in which a consumer is deceived for monetary gain. This is the most common type of class action lawsuit and includes a wide range of fraudulent business practices, including:

  • Defective products
  • False or misleading advertising
  • Violations of consumer protection laws

Employment

Employment class actions can encompass a wide range of abuses against employees, including:

  • Unpaid overtime, minimum wage and other compensation
  • Off-the-clock work
  • Misclassification of independent contractors
  • Missed meals and breaks
  • Donning and doffing
  • Tip pooling
  • Discrimination based on race, age or gender

Securities fraud

Securities class actions help investors who lost money due to an investment they made based on false information propagated by a stockbroker, brokerage firm, corporation or investment bank. Other terms used for securities fraud includes stock fraud, stockbroker fraud and investment fraud.

Environmental disaster

Environmental disaster class action lawsuits are filed if a company causes a massive spill or a toxic substance to be released that places citizens and/or their property in harm’s way. Types of environmental lawsuits include:

  • Oil spills
  • Chemical spills
  • Water contamination
  • Toxic chemicals released by a local factory

Antitrust

Antitrust class action lawsuits are filed by consumers who believe they have been forced to pay more for a product because of antitrust violations.

These types of lawsuits will often allege several companies that make similar or identical products or provide a similar service worked together to artificially raise and fix prices, preventing consumers from benefiting from the natural competitive nature of the marketplace.

Antitrust lawsuits have been filed against airlines, milk companies, bleach makers, computer part makers and several more companies for allegedly fixing the prices of their products to prevent competition.

Privacy/consumer rights

Privacy class action lawsuits address any issue which puts the personal identifiable information of an individual at risk. Consumers are often required to give companies their personal information in order to complete a transaction, even if this is in the form of credit card number. Privacy class action lawsuits not only address such violations, but also how such personal information may be used, according to consumer rights laws passed by Congress. Here are some examples:

  • Data breach violations
  • Fair and Accurate Credit Transactions Act (FACTA) violations
  • Telephone Consumer Protection Act (TCPA) violations
  • Fair Credit Reporting Act (FCRA) violations

Americans with Disabilities Act (ADA) violations

Americans with disabilities have also filed class action lawsuits claiming that companies have violated the Americans with Disabilities Act (ADA), which aims to guarantee Americans with disabilities will have equal access to the marketplace.

Such ADA class action lawsuits have revolved around companies not providing accessible websites or point of sale devices usable by those with visual impairments, movie theaters not providing access to those with hearing and vision impairments, and retail locations not providing physically accessible locations to individuals with wheelchairs and who are otherwise physically impaired.

We have a number of law firms who regularly preview submissions. They may have felt that your complaints weren’t actionable at this time. This doesn’t mean you don’t have a case, or that you won’t be contacted in the future. It just means that the attorneys we work with at this time did not want to pursue it. You are always welcome to consult your own attorney, and should you choose to go that route, we recommend checking out http://www.consumeradvocates.org/find-an-attorney. Once there, you will be able to search a broad database of specialized attorneys in your area that you may consult.

Thank you for reaching out to us with your concerns. We here at Top Class Actions are so grateful for viewers like you, and wish you the best of luck in your pursuit of justice!

Here is the most recent TCA article on the Starkist Tuna settlement: https://topclassactions.com/lawsuit-settlements/lawsuit-news/346002-revised-12m-starkist-tuna-class-action-settlement-gets-final-ok/. On September 28, 2016, the judge approved a revised Starkist settlement agreement. Unfortunately, the amount that each claimant is going to receive was drastically reduced. On 10/25/16, an appeal to the revised settlement was filed. Claims will not be paid until all appeals are resolved. It doesn’t look like the settlement website has been updated to reflect the revised approval or the appeal information, but hopefully it will soon. Here is the TCA article with the settlement details and settlement administrator contact information: https://topclassactions.com/lawsuit-settlements/closed-settlements/103952-starkist-tuna-class-action-settlement/. The article also includes a link to the settlement website. You’ll need to contact the settlement administrator with your change of address information.

Is it possible to file a Class Action against a Life Insurance company that stops you from taking out a policy because you have Fibromyalgia? Fibromyalgia is not a life threatening medical case that I am aware of. So are they basing this on my inability to work because of Fibromyalgia? If so, I am on SSDI and my earnings while I worked most of my adult life are what I receive, not state supplied aid to the disabled. This is horrific news for the millions of people who have Fibromyalgia and did not ask for this horrific illness.
