How to File a Class Action Lawsuit

How Do I Start a Class Action Lawsuit?

If you’ve suffered an injury from a company’s actions (or inactions), you may be eligible to file a class action lawsuit and represent other consumers who have suffered similar harm.

The first step is to find an attorney who is experienced in class action litigation to represent you. Because many defendants in class action lawsuits are large corporations who can afford to pay significant legal fees to defend themselves from litigation, it is important that the attorney you select has the experience and resources needed to bring a strong case.

Does It Cost Me Anything to Start a Class Action?

Most class action attorneys take cases on a contingent fee basis, so you don’t need to pay to participate. Attorneys who work on a contingency basis don’t get paid unless they win the case. After looking into the facts of your class action lawsuit, the attorney will decide whether it is worthwhile to take on.

How Do I Find an Attorney?

When you’re looking for an attorney to represent you in a class action lawsuit, you need to make sure the lawyer is experienced, has a strong record of success and has sufficient resources. Finding an experienced lawyer who is willing to take on your case can be a challenge.

Top Class Actions works with a number of lawyers who have significant experience representing plaintiffs in class action lawsuits. Simply submit your information at our Start a Class Action page to get started. Attorneys in our network will review your case and let you know if you qualify to take legal action. If you qualify, you will be contacted for a free legal consultation.

What Is a Lead Plaintiff?

A lead plaintiff is the person (or group of people) who files the class action lawsuit and is named as plaintiff on the class action complaint. The lead plaintiff serves as the Class representative and therefore must be able to represent the interests of all Class Members.

It is typically necessary for the lead plaintiff to be an active participant after the class action lawsuit is filed. This means appearing for a deposition, hearings, trial, and any other important meetings related to the case. If damages are awarded following a trial or settlement, the lead plaintiff will receive an incentive award for his or her efforts in bringing the case.

2018 Alfa Romeo Stelvio with 44k miles is in shop. Dealer says it’s the oil pump and part is on national backorder, no estimate on delivery, no loaner car, says it’s 18 hours labor and $5k to replace. I see no recalls on the oil pump, but forums are full of oil pump replacement issues. I believe it’s a safety issue, as well as a faulty part issue.

I would like to start a class action lawsuit against Wal-Mart for charging debit card on online pickup orders when the entire* order is a food order and utilizing EBT as payment. The online order will not allow you to proceed without adding a debit/credit card and when contact Wal-Mart customer service 3xs – was informed it was a hold(as this has happened to me several times) but in fact it isnt a hold – its an actual charge as the hold/charge is never released or refunded…also was told this is a glitch in their system however i’ve experienced this personally over 4-5 times consecutively with placing online pickup orders

I was logging into Amazon and was prompted to enter my phone number and password, which brought up information, including financial information for the individual who had my phone number prior to me. I screenshot the information that shows the individuals name and credit card information. I know this is the person prior to me as I used to receive phone calls for that name.

Why is it every time I contact Xfinity/Comcast, I am on hold for in excess of 30-65 minutes? I think this is very irresponsible of them. No one on a 1/2 hour lunch can accomplish what they need to have done by way of speaking to an agent. I refuse to make changes on my account on line. Why are they so understaffed? This has happened to me and others I am sure for years and years. I think it is time a group of us stood up to them. They are overcharging me by $110 this month and I quit TV with them in early August. Multiply this by the number of customers they have and I’m sure it equates to millions of dollars. This is so wrong!

I dont see the area to enter my complaint or information to start an investigation for a class action against IDENTITY IQ.
I signed up for the Identity IQ subscription and trial. They keep sending me emails about not being able to card my card the monthly amount. The emails states just login to your account to update your subscritpion or payment method. It will not allow you to move forward to even get to your dashboard to cancel or manage your subscription. Instead you can just only update your payment info and the rest of the dashboard is unaccessible. I tried calling to cancel it but i was on hold for 45 to 50 minutes before I hung up. The trap you into signing up but do not allow you to cancel your memebership or they make it so difficult to cancel that they are hoping you will just go away and forget about it. I feel like Im trapped. I have still not been able to cancel my subscription.

I discovered a few days ago that back in November, AT&T Wireless added a 4th phone line without our consent. I called them about something else and discovered this 4th line. The associate told me that it’s “only $5 more per month” and that maybe a family member or someone would like it (and of course tried to upsell me a new iPhone). They had a whole sales pitch about how it’s only $5 more per month to which I told them I do not need nor want another line even if it’s only $5 more per month (which, with taxes/fees is really $8 per month). This adds up to nearly $100 per year. After arguing with them for 1-1/2 hours, they allegedly removed the 4th line. I know that this is their business model and that I suspect most of their customers are paying for another line without their knowledge. A customer would only know this if they logged into their account online or get paper bills (which many folks do not). AT&T has 222.84 million customers. Multiply that by $5 and it totals over $1.1 BILLION per year overcharged to unsuspecting customers. Even if only half are scammed, it’s $500 million in revenue.
