How to File a Class Action Lawsuit

How Do I Start a Class Action Lawsuit?

If you’ve suffered an injury from a company’s actions (or inactions), you may be eligible to file a class action lawsuit and represent other consumers who have suffered similar harm.

The first step is to find an attorney who is experienced in class action litigation to represent you. Because many defendants in class action lawsuits are large corporations who can afford to pay significant legal fees to defend themselves from litigation, it is important that the attorney you select has the experience and resources needed to bring a strong case.

Does It Cost Me Anything to Start a Class Action?

Most class action attorneys take cases on a contingent fee basis, so you don’t need to pay to participate. Attorneys who work on a contingency basis don’t get paid unless they win the case. After looking into the facts of your class action lawsuit, the attorney will decide whether it is worthwhile to take on.

How Do I Find an Attorney?

When you’re looking for an attorney to represent you in a class action lawsuit, you need to make sure the lawyer is experienced, has a strong record of success and has sufficient resources. Finding an experienced lawyer who is willing to take on your case can be a challenge.

Top Class Actions works with a number of lawyers who have significant experience representing plaintiffs in class action lawsuits. Simply submit your information at our Start a Class Action page to get started. Attorneys in our network will review your case and let you know if you qualify to take legal action. If you qualify, you will be contacted for a free legal consultation.

What Is a Lead Plaintiff?

A lead plaintiff is the person (or group of people) who files the class action lawsuit and is named as plaintiff on the class action complaint. The lead plaintiff serves as the Class representative and therefore must be able to represent the interests of all Class Members.

It is typically necessary for the lead plaintiff to be an active participant after the class action lawsuit is filed. This means appearing for a deposition, hearings, trial, and any other important meetings related to the case. If damages are awarded following a trial or settlement, the lead plaintiff will receive an incentive award for his or her efforts in bringing the case.

I want to start a Class Action against Progress Residential here in Texas. They do NOT take care of their homes and keep their homes in subpar and some in dangerous living conditions. A/C units not the right size, floors sagging, electrical boxes wired together, undersized for units, etc and yes I have photos The ONLY reason we got it fixed was due I forced medical issues and threatened to contact the fire marshal. They over charge their residents. Upon our last move out with them, for example, we had a leak and had them come to fix it. Suddenly we couldn’t get a hold of anyone for their 24/7 service. When we did on Monday, the guy only fix the roof. He didn’t fix the ceiling, inner wall nor the carpeting. The day we were moving out, it started leaking again. I called it in and was told directly it wouldn’t be my fault because I had already called it and had a job order done. I wouldn’t be charged for the leak, the walls, the painting nor the carpet. Yet they are charging me for everything. They are also charging me for carpet for one room that the pets did not even enter at all. I understood that after two years, carpets were automatically replaced and tenants weren’t charged for it as that’s what the pet deposit was for. We have ESA animals so it was waived so we shouldn’t be charged. Also, they charged us for erroneous HOA fee that we were literally being harassed with. Even on the last day a neighbor was trying to take photos of us while moving and terrifying my Autistic children. Because of this lady our cleaners backed out and Progress refused to extend us a day as well. They also charge exorbitant fees to transfer homes, even if you medical necessity to do so. Generators are not allowed because they will not allow you to put in transfer switches even if you pay it out of your own pocket. But if you use a generator and something went wrong they expect you to pay for everything, therefore you can’t use one because who could pay for their fault wiring?

I want to start a Class Action against Etsy. They are emails members and trying to charge us for shipping fee from years ago. Such as I just received one from 5 years ago. We get a message that they “are actively investigating these shipping charges.” Yet, after a Google search there a dozens upon dozens of complaints of people citing it doesn’t get rectified. I wonder how many people pay without thinking and checking the dates.

I would like to speak with someone about being open to a class action for Career step online classes, they promised job placement & Externship I went to interview Externship place in Macon Ga and the lady from the office at “said Externship” advised that since no hands on training has happened they will not be able to help but she would teach me but it would be at my own expense and my own people. Career step had bad reviews she told me to call BBB and report them & also call them and demand stop payment & contact and close account. The school has made it seem that I stopped reaching out but I have all the harassment emails of the employees reaching out. & also have the locations of Externship places where they have never answered or either the locations she scheduled me. I want to warn others and put a stop to people using their school.
