Will I Need to Testify in Court if I Participate in a Class Action Lawsuit?

If you are a Class Member in a class action lawsuit or settlement, you do not need to testify in court. If a settlement is reached, you may have the option to speak at the Final Fairness Hearing. Class Members who wish to speak at the Final Fairness Hearing typically must submit a “Notice of Intent to Appear” to the court by the specified deadline. This information will be available on the settlement notice and/or the settlement website.

What if I’m a Plaintiff in a Class Action Lawsuit?

If you are serving as a named plaintiff in a class action lawsuit, you may be asked to testify in court. The lead plaintiff has an important role in a class action lawsuit, and serves as the Class Representative. As the Class Representative, the plaintiff must be able to fairly and adequately protect the interests of the other Class Members.

Being a lead plaintiff in a class action lawsuit can involve a significant amount of time. Class action plaintiffs get to be involved in the case and any settlements that may be reached. They must be available for depositions, hearings and trial. Therefore, they may be asked to testify before a judge in court.

If a judge rules in favor of the plaintiff or the class action lawsuit is settled, a judge may award the plaintiff a significant incentive award for all the time and effort he or she put into the case. This award will be much more than is offered to the Class Members.
