Why file a class action lawsuit

Why File a Class Action Lawsuit?

A class action lawsuit is a type of lawsuit that is filed on behalf of a large number of consumers who have suffered similar harm by a defendant. This type of litigation is efficient because it consolidates a large number of potential claims that, if brought individually, could clog up the court system. There are several reasons to file a class action lawsuit instead of filing an individual lawsuit against a defendant.

The Damages Are Small But Widespread

In some cases, a defendant’s actions cause seemingly minor harm, but affect a large number of consumers. For example, if a personal care products manufacturer advertises a shampoo as being “all natural” but it actually contains synthetic ingredients, anyone who purchased the product may not suffer any sort of quantifiable physical harm. However, they have been harmed because they did not receive the type of product they thought they had purchased. Further, they may have paid a higher price for the “natural” product than they would have paid for a competing product that did not claim to be “all natural.” The damages each individual purchaser suffered may amount only to a few dollars — not enough to sue over in an individual lawsuit filed by one consumer. But when you consider the thousands of consumers who may have purchased the product, the defendant could be liable for a significant chunk of money.

You Want to Hold a Company Accountable for Wrongdoing

If a company’s actions have affected a large number of people, a class action lawsuit can help hold it accountable for wrongdoing. By filing a class action lawsuit, you will force the company to defend its actions. They must respond to your initial complaint and any subsequent motions unless they are able to convince a court to dismiss the class action lawsuit. If you are able to make a strong case against the defendant, you may be able to win at trial or convince the defendant to settle the class action lawsuit before it goes to trial. A successful class action lawsuit can lead the defendant to change its problematic behavior and/or offer compensation or other benefits to affected consumers.

It Probably Won’t Cost You Anything

Class action attorneys are typically selective about the cases they take on because they don’t get paid unless they win the case. They work on a contingency fee, which means they are awarded attorneys’ fees following trial or settlement. The amount they receive is typically based on a percentage of the amount recovered on behalf of the Class, and must be approved by a judge. Before you agree to have an attorney represent you as a plaintiff in a class action lawsuit, make sure you’re clear about the payment expectations.

Regarding the ethics of SPS – like so many other people have been shafted by SPS – I fought through Katrina with a forbearance – over the next 12 years of paying on my loan and having a modification I owe more on it than I bought it for – I have not been late on a payment since 2012 and I paid an extra $200 per month – last year when I checked with SPS my remaining principal was about $80,000, this year I owe $122,000 – is there an attorney out there willing to take SPS on in a suit

I’ve been looking to see if anybody has filed a class action lawsuit against Century Link Internet. They are providing us with the slowest service possible which makes it even slower than that. I have a screenshot where my server actually told me that there was a problem with my Internet connection that I should try dial up. We are paying the same amount of money as originally started which was faster. I have written letters to corporate office with response back that there’s no chance of any upgrade or updates now or in the future. It’s in writing actually two letters. I have many screenshots where is told to me that I have connection problem with my Internet. There are about 250 people in our area of which only 75 are connected because that’s all Century Link. has allowed. The box where the Internet and telephone lines are is congested, overcrowded and overloaded. It shuts us down several times a day by freezing up and restarting or rebooting our iPads or computers. They have clearly ignored our issue in the Tahuya River Valley Community. We are outside of the Belfair area about 9 miles from the BELFAIR State Park. Our other option would be an expensive satellite system that many of the retired or disable people who live in the here cannot afford. We expect Century Link. to be accountable for the plan that they provided us. There’s only one speed they give us and that’s slow and they will not allow for anything faster nor can we download or upload very often. I cannot watch movies or even know how to YouTube or do our banking to pay her bills in a timely manner before it will freeze up and shut down. Because it’s too slow. I have tried to even email the vice President Century Link named Sue Anderson every time I try I’m usually shut down in the middle of my email. If I have any upgrades for my cell phone or my iPad or computer I have to drive the 10 miles to Belfair in order to get my apps and programs upgraded. Century Link has in writing plus many verbal telephone calls and emails of our complaints. They know it’s congested, and that’s due to the kids coming home from school who play all of their games online. There’s also the Wii, PlayStation and Sega, and whatever else electronic equipment that’s new for game playing online. Not to mention people who need to do their business or go to school or download homework for the children. I’m concerned about the phrase “no Child left behind” when is very clear that the children are being left behind because teachers are in the 21st-century and are giving them homework they have to download. One home alone in our area has seven electronics at a time going when the children are home from school. It’s not acceptable what Century Link is doing to us and we are at our wits end. I have seen news stories as “Get Jessie” or the recent king5.com article actually interviewing the VP on TV. She claims that their customer service is excellent and they strive to keep it that way. Well they’re not. Is there a class-action lawsuit going on now for these reasons?
Century Link came to our area after we petitioned them to come in 2008. I was told they were afraid they wouldn’t get the business from our neighborhood. So they put up 75 places and not enough for all that want to subscribe. We purchased three rental homes in the area not knowing that Century Link was not going to take any new subscribers. We also were not aware of the bogging down of the current Internet we have. It’s very hard to rent a home or even sell a home when you have no real Internet service. We’ve invested in property to subsidize our Social Security income, Yet when people ask about our Internet service they won’t rent here. Its because some of them work at home and need a fast Internet provider, Century Link. does not provide that here. And from our understandings will not. They won’t provide now nor do they have plans in the future to do any upgrades or updates for our area. This is just frustrating and money consumer for us. Most recently when a customer calls to complain about trouble on the line they will look on their computer sitting at a desk as far away as southeast Asia in my case, and tell us they shown nothing wrong. But clearly we have something wrong. So they’ll send out a tech and the tech is telling the consumers that it’s our computers that’s bad. So now people are taking their computers and then have them looked at, when in reality we all know it’s the century link Internet provider.
Wave cable has shown some interest in providing something in the future. Apparently there’s some fiber optic lines out there on the main road about 2 miles away. We are all hoping for that, but have had no more word on it.
When someone takes your money, and not provide a service, we have always called it “stealing” what can we do as a community who lives around the forest?
