TracFone Straight TalkTop Class Actions readers are starting to report receiving checks in the mail from a class action settlement over allegations that TracFone Wireless mislead consumers about its “unlimited” data plan.

According to the settlement website and reader comments, Class Members who submitted timely and valid claims for the TracFone settlement began receiving checks worth as much as $45.12 on Mar. 26, 2016.

Top Class Actions has been following the TracFone “unlimited” data class action since 2013, when a group of consumers targeted both Wal-Mart and TracFone for throttling or terminating data access on “Straight Talk” plans.

The Federal Trade Commission went after TracFone in a lawsuit alleging that before 2013 consumers had no idea that the prepaid phone plan reduced consumers access to data between 60 to 90 percent in an effort to cut costs for the company.

In January 2015, a $40 million settlement was reached and was granted final approval that July, despite objections that the individual pay-out amounts would be too low. In addition to the cash settlement fund, TracFone also agreed to stop advertising data plans as “unlimited.”

The TracFone settlement website initially reported that it would be sending out checks to Class Members in October 2015. However, they recently updated the site stating that checks were sent out between Mar. 22 and Mar. 29, 2016.

According to the settlement administrator, TracFone checks must be cashed no later than July 20, 2016 otherwise they could bounce.

Class Members in the TracFone lawsuit settlement include individuals who purchased a Straight Talk, Net10, Simple Mobile or Telcel America wireless service plan that was advertised to include “unlimited” data within the U.S. between July 24, 2009 and Dec. 31, 2014, and had data usage slowed, suspended, or had all phone services terminated by TracFone before the service plans’ expiration date.

The deadline to file a claim for the TracFone unlimited data settlement passed on June 19, 2015.

    How are ya’ll get $1,000 and more?? I got SEVEN DOLLARS AND FIFTY FOUR CENTS!? They spent more on the paper to print the check then I’ll get. I’m not even wasting the gas to go cash this, I’ll deposit it when I go to the bank for other reasons. This is ridiculous…what’s the damn point of $7.54?
