Mercedes-Benz E-Class W-211 Water Defect Class Action Lawsuit

Mercedes-BenzA federal class action lawsuit claims Mercedes-Benz E-Class vehicles from the 2003-2009 model years are “highly prone to water leaks and flooding” that damages the electrical system and interior and can lead to sudden engine failure while the vehicle is being driven.
 
The Mercedes-Benz W-211 class action lawsuit claims Mercedes-Benz has known about the alleged water defect since at least October 2002, if not earlier, but “actively concealed and failed to disclose” the defect to consumers.
 
The alleged Mercedes-Benz water defect affects the W-211’s water management system, which is designed to divert water away from the interior cabin area and away from the electrical components of the vehicles during rain or when the vehicle is being washed.
 
According to the class action lawsuit, however, the water management systems in 2003-2009 E-Class W-211 vehicles are “uniformly and inherently defective in materials, design and/or workmanship because they become clogged with leaves, twigs, debris and other objects that enter the water management system.”
 
As a result, the vehicles “present a safety hazard and are unreasonably dangerous to consumers because of the danger of catastrophic engine and/or electrical system failure as a result of water entering and flooding the vehicle’s interior cabin, damaging its internal components, and coming into contact with the electrical components of the vehicle, when the vehicle is in operation,” the Mercedes-Benz class action lawsuit states. 
 
The Mercedes-Benz E-Class W-211 class action lawsuit is brought on behalf of all current and former owners who purchased or leased a 2003-2009 Mercedes-Benz E-Class W-211 vehicle in the United States. It is seeking damages for any repairs Class Members made because Mercedes-Benz refused to honor its warranty, an order requiring Mercedes-Benz to repair the water leak defect, and more.

    I have a 2009 Mercedes-Benz E-350 with only 77K miles on it and after it raining for 2 weeks straight in Florida all portions of the car have been completely saturated with water. The trunk, the interior, under the hood the fire retardant material was soaked and dripping water all over my engine ruining the cars ECU/PCM. And I don’t know who thought it would be a great idea to place the ECU/PCM on top of the motor and not in a safer spot.
    This is outrageous that such a pricey car can have so much water intrusion. I’ve been a loyal Mercedes owner for years and have taken excellent care mechanically and cosmetically and it’s such a shame that it’s gonna be a total loss now because of their poor engineering and skimping for cheaper materials.
    However I would like to have someone contact me regarding the class action lawsuit. My info will be provided below. Thanks!

      Hi Bryan. I am just seeing your post. I live in Florida and also experienced this same event with my Mercedes s350. Did you get any responses that you could share with me. This is a ridiculously expense mistake on the part of Mercedes.

    All Mercedes Benz model come with low quality seam sealer that cause leaks through all spot welded parts: roof, rear body upper panel to mention a few. These leaks cause major repairs such as having to replace. sam modules, ISM transmission module & tail gate motor to mention a few.
    Stay away from buying Mercedes Benz unless it is a classic Benz. They are built extremely poorly.
    I will dump my GL450 for next to nothing after spending over $12,000.00 in this vehicle.

    I have two Mercedes Benz one a 04 sclass 430 and the other 06 e350 both broke down within 1 month of each other. S class 430 gear shifter stuck in park,doors will not lock,air conditioning stop cooling, air shocks went out in the front. Car keep going up after its parked overnight.trunk won’t open with remote. 2nd e350 tires balding on the inside after alignment on all four. Transmission electronic plate failed after only 128,000.00 miles. Left strut went bad would not rise cost 1200.00 for parts and labor wow. I need to know lawyer to contact me immediately.
