Millennium Products GT’s Kombucha & Synergy Beverage Class Action Settlement

Millennium Products, the makers of the popular “GT’s Kombucha” and “GT Synergy” beverages, has reached a class action lawsuit settlement over failing to warn consumers that its “non-alcoholic” beverages actually contain as much as 2-3% alcohol – equal to or greater than some brands of beer. As a result, anyone who purchased GT’s Kombucha or Synergy between 2006 and 2010 will be eligible to receive either a full cash refund of their purchase or up to $6 in coupons from the class action settlement.
The Millennium Products settlement will resolve a 2010 class action lawsuit, entitled Ilana Gauss v. Millennium Products, Inc., that alleges Millennium falsely stated that its beverages would contain “a trace amount of alcohol (less than 0.5%)” and failed to warn consumers that they could or did contain more than this – sometimes as much as six times more alcohol. The Synergy and Kombucha class action lawsuit further alleges that Millennium marketed, displayed and sold the beverages as if they were non-alcoholic soft drinks or tea, including to children and persons who would not knowingly have consumed alcoholic beverages, such as at work or before driving. 
Millennium denies any wrongdoing but has agreed to settle the Synergy and Kombucha class action lawsuit to avoid ongoing litigation.
 
Under the proposed class action settlement, Millennium has agreed to provide full cash refunds to Class Members who can provide proof of purchase, such as an itemized retail receipt or credit/debit card statement that shows the beverages purchased, the date and the place of purchase. Class Members who cannot provide proof of purchase can file a claim to receive up to $6 in coupons that can be used to purchase any of Millennium’s “Enlightened GT’s Kombucha” or “Enlightened Synergy” beverages. These beverages are produced with a different formula than the settlement beverages to minimize the risk that their alcohol content will rise above 0.5%.
Class Members of the Synergy and Kombucha class action settlement include all persons who purchased the beverages in the U.S. between September 8, 2006 and September 1, 2010. 
To receive your cash refund or beverage coupons, you must submit a valid claim form and any proof of purchase either online at www.GTSettlement.com or mailed to the Settlement Administrator no later than December 22, 2011, or 30 days after the Court’s final approval of the Kombucha settlement. A Final Fairness Hearing will be held November 22, 2011.
