Honest KombuchaThe makers of “Honest Kombucha” beverages have reached a class action lawsuit settlement for falsely stating their beverages contain “a trace amount of alcohol (less than 0.5%),” when they actually contained up to 2-3% alcohol — as much or more than some brands of beer. As a result, consumers who purchased Honest Kombucha tea within the last five years can receive a full refund or up to $7 in coupons from the class action settlement.
 
The Honest Kombucha settlement will resolve a class action lawsuit, entitled Scott Witthoff v. Honest Tea, Inc., that alleges Honest Tea knowingly or intentionally labeled and marketed its Honest Kombucha tea beverages in a manner that was false or misleading as to their alcohol content. Honest Tea denies the allegations and maintains that if there were instances where the beverages exceeded 0.5% alcohol, such instances were exceedingly rare and sporadic. The company has decided to settle the false advertising class action lawsuit, however, to avoid ongoing litigation.
Millennium Products settled similar claims that its kombucha tea products contained as much as six times more alcohol than advertised in their GT’s Kombucha & Synergy Beverage Class Action Settlement, reached earlier this month.
Under the Honest Kombucha class action settlement, consumers who purchased Honest Tea’s kombucha beverages between October 29, 2006 and October 3, 2011 can submit a claim form to receive one of several benefits, depending on if they have proof of purchase.
Settlement Class Members who have a valid proof of purchase, such as an itemized retail receipt or a credit card/debit card statement that shows the beverages purchased and the date and amount paid, can submit a claim to receive a full cash refund of the purchase price they paid. They will also receive a $1 coupon for each additional $1 they declare to have been paid.
Settlement Class Members who do not have proof of purchase can file a claim to receive a $1 coupon for each $1 they declare to have paid.
Honest Tea no longer makes kombucha beverages, but the settlement coupons can be used toward its numerous other beverages. A maximum of $7 in coupons will be issued to any Settlement Class Member, and up to $3 in coupons can be combined towards the purchase of any single Honest Tea beverage.
To receive your cash refund and/or coupon from the Honest Kombucha class action settlement, you must submit a valid claim form and proof of purchase (if necessary) to the Settlement Administrator either online at www.HonestKombuchaSettlement.com or via first-class mail no later than January 24, 2012 or 30 days after the Court’s Final Approval of the Settlement, which ever comes later. The Final Approval Hearing is scheduled for January 6, 2012.
