$4.095M Costa Del Mar sunglasses warranty class action settlement

Costa Del Mar agreed to a $4.095 million class action settlement to resolve a class action lawsuit claiming it charged warranty fees in violation of the Magnuson-Moss Warranty Act.

The Costa Del Mar settlement benefits consumers who purchased a pair of non-prescription Costa sunglasses before Jan. 1, 2016, and who paid Costa a warranty fee to repair or replace those sunglasses between Aug. 20, 2013, and Feb. 29, 2020.

The Costa class action lawsuit claimed the company violated the Magnuson-Moss Warranty Act by charging warranty fees despite offering a “Lifetime Warranty” on its sunglasses. Plaintiffs in the case argue that they deserved a full sunglasses warranty under the law.

Costa Del Mar is a sunglasses company that sells a variety of eyewear, including prescription sunglasses.

Costa has not admitted any wrongdoing but agreed to pay $4.095 million to resolve the warranty class action lawsuit.

Under the terms of the Costa Del Mar settlement, class members can receive a cash payment based on the number of eligible repairs they had done on their sunglasses. Class members who had more repairs done will receive a larger share of the net class action settlement fund. Exact payment amounts will vary.

The deadline for exclusion and objection is Oct. 8, 2026.

The final approval hearing for the sunglasses warranty class action settlement is scheduled for Jan. 20, 2027.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive settlement benefits. Those who have received a unique ID and PIN can select their payment option online.
