Consumers who were prescribed Suboxone could benefit from a $500,000 Federal Trade Commission (FTC) settlement over false advertising and antitrust violations.

The settlement benefits consumers who were prescribed Suboxone oral film between March 1, 2013, and Feb. 28, 2019. 

Suboxone is a medication used to treat opioid addiction, according to Drugs.com. The medication comes in a tablet and film form. 

According to the FTC, Reckitt Benckiser and Indivior conspired together to maximize Suboxone profits at the expense of consumers. In an attempt to convince more patients to take their branded medication, the companies allegedly deceived patients and doctors with claims that the film version of Suboxone was safer than tablet versions.

To secure their profits from this alleged false advertising, Reckitt Benckiser and Indivior suppressed generic competition by filing “meritless” petitions with the U.S. Food and Drug Administration (FDA), the FTC contends. These petitions reportedly repeated unsupported safety claims about the film version of Suboxone and urged the FDA to reject applications for generic tablet alternatives.

The FTC says these actions caused consumers to pay more for Suboxone when, in a healthy market, they would have otherwise been able to purchase less expensive generic versions of the medication.

In July 2020, Reckitt Benckiser agreed to a $50 million settlement to resolve these claims. Shortly after, Indivior agreed to pay $10 million to resolve the allegations.

In May 2021, the FTC distributed over $59 million to consumers who were prescribed Suboxone. Of this sum, $42 million was sent in the form of 37,212 checks while the remaining $16 million was sent as 14,663 prepaid debit cards. The 51,875 payments averaged $1,139. 

With the remaining $500,000 from the settlement fund, the FTC is distributing payments to consumers who submit a valid claim form

These payments are only available to consumers who contacted the claims administrator after the original 2021 claim deadline and asked to be put on the waitlist for payments. Consumers cannot file a claim if they did not add their name to the waitlist before September 2021, even if they otherwise qualify for payments. 

No deadline for exclusion or objection is listed on the settlement website. The Suboxone FTC settlement is not subject to final court approval.

In order to receive a payment from the Suboxone FTC settlement, consumers must submit a valid claim form by Nov. 26, 2022. To file a claim, consumers must use the ID number they received via email or mail.

      What if you used a client to receive the medication? And were charged a daily fee for it? Would that qualify a person? and if so is it to late to submit a claim? I just seen this . My boyfriend has been on it for several years now well since before I met him in 2015.

    Yes please add me as well.ive been on suboxone gor ten years.been to the dentist alot for tooth decay.hasnst been pretty.and extremely painful days.due to suboxone.

    Will the claims that got in on this remaining $500,000 get the same amounts that were dispersed to the first settlement claim numbers? Some we’re around $2500 for people that used sobocone for the entire 18 months of something that the claim period was for. Be interesting because $500,000 isn’t much for a large group of claims- hope we qualify for the same amounts.

      No. If you qualify and were on the waitlist, you will receive the amount that you qualify for. The amount was based on how much you paid and how long you were on suboxone. So NO you wont get the same amount as 1st round people

        I guess I should have rephrased my question. And sounds like you don’t know because your answer made no sense. Does anyone know if they will be calculating the payments for this round of people to the same payments that individuals got calculated by month. And I was on the waitlist. I did not mean will we get the same amounts, but rather will our claims be prorated differently that the previous round got per month.

      I’ve been in and out of the hospital since the end of 2021 and ask throughout 2022, the end of October was the longest stay yet unfortunately I was magically neglected on many levels and multiple times I was mistreated given wrong meds misdiagnosed and worse. Maybe irrelevant too others but for myself I’m still sick from the hospital literally giving me a virus in October through my iv I’m still down had 104.9 fever all month of November and I did receive my ID number yet only now am able too fill out claim. It’s only right if you keep your word as keeping me in apart of and one to receive payment from this class action. Please tell me am I wasting my time?

    Now that the deadline has expired for the WAIT LIST CLAIMS filed, does anyone know WHEN checks would be dispersed? For all of you people commenting “add me” or “I never got a claim number” you’re probably out of luck and I don’t want you having false hope.

      I did the same as you. II was told t’s going to be months .I’ve emailed and asked. They said they have to process all the claims first and then it will be months after that so who knows?

    OMG I did get 2 letters with ID number but I wasn’t notified that had to be submitted November 26 2022 today is November 27th 2022
    I cannot believe I wasn’t advised of this I Only found out by googling the status of the settlement
    I guess I’m screwed now Does anyone know if I have or done have any chance now ??

      Unfortunately they’re strict on that deadline date. My lil sister got the claim offer sent to her via email and by the time I got to it to help her they said it was too late.
